Of course if scotus says Trump can’t invoke the insurrection act whenever he wants—and I have no faith at all that they would, they’d most likely say it is his call, imo—that opens up a lot of ways to shut him down. Hadn’t thought of governors intervening, that’s an excellent point.
But, he can still push forward and test the boundaries with zero personal consequences. You have way more faith in our congress than I do if you think they’ll do anything about it. Impeachment is out of the question. Making a law requiring congressional approval is also highly unlikely, unless the dems get control.
You’re right about the military and I mentioned that already. So, in this hypothetical scenario, it all comes down to loyalists for Trump versus the those loyal to the constitution. In any case, a shit sammich when he says “fuck you, Roberts”. Which is why I think this pussy scotus will just say the potus can do whatever he wants, which they already have done time and again.
But the Supreme Court overruling him still has value. It makes it legal for US State Governors to order National Guard troops to stand down, when Trump issues the National Guard unlawful orders.
