What decade are we talking about? There's never been a decade where Jones didn't fight. Gane was the number one contender when Jones finished bulking to move up to HW. Tom was never denied a title shot.

1) Jones fights #1 Gane while Aspinall is ranked #7
2) Jones and Stipe sign a contract to fight
3) Jones gets injured while #7 Aspinall and #4 Pavlovich fight for the interim title
4) Aspinall agrees to take a busy fight against Blaydes while Jones and Stipe complete their contracted fight

From a legal standpoint, Tom can't bypass the contract that Stipe already signed, nor can the UFC. They legally have to finish the fight in the contract or offer Stipe something else that he's willing to take, which he was not.
