It wasn’t ruled constitutional. They didn’t rule on the constitutionality of DACA, just that Trump’s rescinding of it was too “arbitrary” and didn’t consider the built “reliance” on the program.

Which was a bullshit ruling because a President should need no “good reason” to rescind an EO via EO. Even constitutional EO’s. Which DACA is not..but that was when the court still had Kennedy and Ginsburg so Roberts was still the kingmaker. But it was basically a stupid humanitarian argument and delay tactic which had no legal basis. They just didn’t want to end the program while also not empowering Executive Orders to become settled law.


They punted the question of whether DACA was constitutional even though it’s beside the point anyway.

If they had ruled it was constitutional. Then that would be that but it wasn’t as the current federal ruling on DACA(as of 2023) is that it is absolutely unconstitutional and the injunction simply doesn’t affect people still in the program until the Supreme Court hears its again..which they are dragging ass on doing.

It did prevent Biden from doing any expansion of DACA despite several efforts.

What are you talking about? I didn’t say Biden ignored the courts. I’m not the same person you were arguing with earlier in the thread. I saw your post saying that DACA was ruled constitutional. That is false.


if the Supreme Court ruled DACA as constitutional then there is no way it would be back up to the Supreme Court awaiting a hearing as it is today…and Biden would’ve been able to expand it when he wanted to.

If the Supreme Court rules that something is constitutional. A lower court can’t rule it as unconstitutional starting the process again.

They also didn’t say what Trump did was illegal. Read John Roberts opinion. It was more or less “This is mean. Won’t you think of the poor dreamers? We don’t like how you went about this. Go through the process again”. Which was bullshit and won’t be repeated whenever they decide to hear it again.

They’ll likely just let the lower court ruling that DACA is unconstitutional stand since nobody really gives a shit about the dreamers anymore. As long as it can’t be done again

Go back in the thread to see what started this whole convo, what Trump is doing is without precedent, they already came out and said that the Executive has no limits and no duty to follow laws or court rulings.
