Bomm ba yee (whatever) is full of shit. Wand had just finished the pre fight press conference for UFC 175 (vegas) so he was going to fight in Nevada.
Funny, doing a press conference means you are going to fight in that state. I thought it was the CONTRACT and paperwork that determined if Wand was going to fight in that state.
That excerpt simply states they can fine anyone under their jurisdiction, it does not state or imply anyone defined as a contestant is under their jurisdiction by default. Since Wanderlei was not licensed, pursuing a license or contracted to fight in Nevada how was he any different from any amateur contestant?
When it comes to fighting in the stat of Nevada they do have jurisdiction over any profetional fighter in the world. That is how they were able to test Vitor as soon as he got off the plane.
The definition of a contestant is just what I posted, it cam right from the regulation.
They were only able to test Vitor because Vitor allowed them to, and signed a contract to that effect. Even then, they did not punish him because at that time they did not believe they had the jurisdiction to do so since he wasn't licensed. The regulation defines contestant, but I don't see where it says they have automatic jurisdiction over anyone who fits that definition. You are right on that. Therefore he must have signed the bout agreement, but the rumor at the time is that he still hadn't signed it. Chael called him out on it multiple times.
Has he fought for money before? Has their been an indication that he plans to fight for money in the future (at the time of him refusing to take the test)?
That is all the is needed for the commission to defind someone as a contestant and declare them under their jurisdiction. That is the way state commissions, boards, and athorities operate.
It doesn't need to be to place him under their jurisdiction. He is a fighter. Who just announced his plans to fight within their bounds. He also has a contract with the UFC, who are also bound by the authority of the ACs.
What I love most about this argument is that you guys aren't discussing weather or not he cheated. People are trying to argue that no one quite had the authority to catch him cheating.
