I have ZERO faith that this Court has the balls to essentially outright declare that Presidents are exempt from the 14th Amendment, or to suggest that more bureaucracy (via Courts or Congress) is the answer. This leaves open too much of a possibility that Biden simply refuses to leave office. With more Democrats playing politics hardball, Habba threatening Kavanaugh, and Biden's recent scathing statements about Trump, they have to be very careful here. Sure they could have just refused to hear it, but Trump has lost some modicum of favor with the likes of the Federalist Society. This screams, to me, to be more of a symbolic gesture where they will attempt to legitimize the Court by ruling that this is a State issue, in an effort to suggest they ARE ideologically consistent. It would be a fairly political neutral move at a time when the Court is facing increasing scrutiny. They can sort of reject Trump, and sort of uphold Democracy, formally.

That's just a hunch, though. Would it surprise me if they declare Trump God-King? Nope. About the ONLY thing that would surprise me is if they uphold Colorado's ruling and Trump is automatically disqualified from all States. Though given how badly the GOP establishment t wants Haley to be the candidate, it's not impossible. Just highly improbable.

The X-Factor is how comically sh*tty Trump Lawyers are. They will get absolutely shredded in arguments, so it will be plainly obvious that the Judges will rule based on their current biases.

The problem I keep alluding to is “insurrection” isn’t a well defined thing that is commonly accepted and understood. Like every state accepts a birth certificate, and everyone knows what an impeachment conviction is. They could rule that the potus is subject to the amendment, but it wasn’t proven an insurrection took place, no?
You make an interesting point I hadn’t really thought of, though (seems obvious now). If they uphold this ruling then we can look at J6 as an example of an insurrection and Trump is toast.

The $250 million fine was from 2022. They have since revised it up to $370 million:

$168 million is interest that Trump saved through fraud
$152 from the sale of the Old Post Office building in D.C.
$60 million from the transfer of the Ferry Point Golf Course contract

I don't know exactly what the end result will be, but since the judge already ruled Trump committed fraud, it's going to be something substantial.

Well, but Colorado has 2 strengths here

1) a lower Court DID rule that Trump incited insurrection
2) they cited a previous SCOTUS ruling as a basis for this ruling

I'm not sure if they can declare J6 was NOT an insurrection or that Trump wasn't sufficiently proven to have at least "given aid or comfort." And if I was advising any of them I wouldnt touch that with a 10 foot pole. What's more murky is the definition of the Presidency. Is it an "office?" Clearly it is, but what type? But this is where they hit a brick wall, because there are other Constitutional disqualifiers used all the time that don't require a bureaucratic ruling.

It's really a sh*tty position for them to be in. That's why I say the slipperiest way out is for them to just go "well we ARE Statists."

Yeah I’m not really sure how scotus is even relevant in this. Seems it’s up to Congress by the language in the amendment.
 
After Trump gets fined, his cult will panic wrestle with "a Trump never pays his debts! You'll never make him pay!"

Problem with this theory is that Trump has unmovable assets in NY. He can't pick up Trump Tower and hide it in Florida...or Moscow. Hopefully after the state seizes it they blow up the Trump Tower sign like this:

The Maine one is even more complicated because they would have to overrule not only the State Constituton, but the provision in the US Constitution that gives the States control of their own elections. This seems like an even bigger ideological landmine, and a bit like their "Independent State Legislature" theory coming back to bite them in the @ss

At the end of the day, they can just make up whatever ruling they want. It's the effects of their ruling that actually matter, not the tortured reasoning. They don't need to apply any rationality or consistency to a decision for it to be just as binding as one that is, you know, well constructed.
