Well he has total immunity for constitutional duties, limited immunity for official acts (like giving a speech as president), and no immunity for non-official acts.

To me, I think his team can argue both constitutional duties, because if an election was STOLEN, it would be an official duty to investigate and do everything they can to rectify the situation, such as challenging the election via the electoral count act of 1892, that once Biden took office, the had to change, because it was totally legal for Trump's team to do what they tried to, before the riot.
