Law Illegal migrant, gets probation for killing woman

i think you dont know what just means man..... death penalty? really? thats pretty harsh man. people make mistakes and some of them go on to live wonderful full happy and useful lives.

ive got a friend who was high when he was 17 with some freinds in a car and they wrecked the car and killed somebody.... he is a deeply spiritual human being who really does serve humanity daily.... an exceptional person even.

you would have him shot dead? no man. you are wrong about life and meaning and purpose and redemption.
Redemption doesn't bring back the person that was killed. Neither does an execution, but it brings revenge and acts as a deterrent for others. If we treated this the way we should, which is harshly, we'd see less of it. This kid doesn't deserve a second chance, and neither did your friend.

Well you have a demented mind. I'll give you that. I would try to explain to you how much you're missing about life but you wouldn't be able to understand it.

Hence "in the vast majority of cases".

Here's how the law works: A death is tragic but it doesn't automatically outweigh all of the other facts involved in a case.

Yes, most kids that swipe their parents car don't end up killing someone. And most car accidents that result in someone dying don't include sending the other driver to jail.

And most minors don't get sent to prison unless they intentionally did the thing that they are in court for. Did the kid take his parent's car intending to kill or harm someone or was the death an unfortunate side effect of what he did intend to do, which is speed in his parent's car. Speeding was intentional, harm to a 3rd party was not. So, conviction for vehicular homicide makes sense. But probation makes sense because it's a minor who didn't intend to kill someone.

I had a brother-in-law that spent 2 yrs in juvy for stealing a car and wrecking it - no one else involved.

Felonies don't usually lead to simple probation unless your family is connected.

No, but it means its not Felony manslaughter as @oldshadow implied.

Seems that it usually is in most states.

Including Colorado:
Colorado, if a joyride results in death, the penalties can be severe. A conviction for vehicular homicide, which is a class 4 felony, can result in 2 to 6 years in prison, plus a mandatory 3-year parole period, and a fine ranging from $2,000 to $500,000.

Again, then your problem with Colorado Law not with Colorado DA.

I agree with you going 90mph in a 45mph should be a felony, but the law treats it as a misdemeanor which is dumb as fuck.

No it doesnt:

Weaver said prosecutor initially promised to pursue the maximum sentence of two years in youth corrections: "

Weaver says the The DA's office said this would be a 'no plea deal' case, so they were not going to offer anything; any concession."

That changed, he says, when the Arapahoe County District Attorney's Office changed hands a few months later.

Under the new District Attorney Amy Padden, Weaver says the teen was offered two years' probation if he pleaded guilty.

Why are the same posters always wrong about what the law is or isnt? Is it intentional?

Your disregard towards the victim, the victim's family, and justice itself is disgusting and disgraceful.

Thankfully your demented and warped view of humanity is not shared by the majority of people on the planet.

You're welcome to your extreme views. Just know that you live in a world filled with people better than you.

Its not that hard to read your own source man

Aiello said the boy was convicted of two counts of vehicular manslaughter, two counts of evading a police officer causing death, three counts of evading an officer and causing injury, evading a peace officer while driving recklessly, evading a peace officer while driving in the opposite direction, child endangerment, vehicle theft and driving without a license.

Maximum sentence of 2 years in youth correctional, after a trial, in which the kid may not even face the maximum sentence to begin with and could be still eligible for early release.

For adults

Yes it is if she let him drive the car then she could have been held accountable for her part in this. He didn't have a driver's license and took the car without her permission which is stealing it.
- Wond't she have to press complaint(sp?)?

We need to re-evaluate punishments for serious crimes when it comes to people below 18. Killing someone and getting community service is simply unacceptable. I remember when I was 15. I could do advanced calculus. Our brains are developed well enough to know that stealing a car and going 90 in a 45 is unacceptable, and I refuse to even converse with anyone who suggests otherwise. With gang members recruiting younger and younger it's clear that the current system is completely broken.

I don't care about small or petty crimes, or even things like battery with no serious bodily injury.

The fact that he was here illegally is just extra spit in the faces of law-abiding Americans and legal immigrants.
- We had a 15 year old with five rapes here a couple of years ago.

Yea I'm understanding she would to be not responsible for anything he did financially and some legally but I'm not sure in that state what is involved and the charges.
