bringing a constitutional argument into this is kinda silly. this is all a big political grand stand.

democrats would be doing the same thing if ginsberg left the court at the end of the bush years. that goes without question. so democrats arguing republicans are violating the constitution, and republicans pointing to chuck schumer, just look like a bunch of idiots flapping their wings and trying to jump off the roof of their houses.

the basic political reality is that obama is going to replace the conservative justice leader on the court with someone of his choice, who in all likelihood is going to be moderate at best. those are the breaks. if republicans are going to seriously attempt to stall this for over a year, when there's a good chance they won't even win the election, then they are going to infuriate so many voters that they'll lose all of congress and will struggle to rebound for years to come.
