Would you approve of Trump using emergency powers to build his wall?

Considering he's gotten two appointments to that court, including one that he shouldn't have, already hemming and hawing means he thinks its DOA.

And it should be.

The idea that he declare a national emergency after the congressional debate on the subject when the entire purpose of the ability to declare an emergency is to deal with an issue that doesn't permit time for Congress to debate.

Looking at it OBJECTIVELY now, it really seems like he's just doing it to say "SEE? SEE??? I'm trying my hardest to get a Wall for you, my fellow Voters. But the Democrats are in the way as usual".

This is just a ploy to have his 2020 Campaign gain some steam.

That's all this ever was.

It's to the point that the Constitution except for the EC and the 2nd Amendment is a burden to what is the current Republican party.

BTW, speaking of the EC, you've heard of the COMPACT, right?

National Popular Vote Interstate Compact

That whole movement where they're trying to basically change the EC into a Popular-Vote system.

That is scary.
 
and the Emergency provisions are designed for when the POTUS DOES NOT have time to try and go through the House and Senate.

He was given the power to bypass when time was of the essence and response was needed now, not after Congress and the Senate convened sessions to debate.

In all other instances where that time is not of the essence then it is required to go through Congress, to be debated and for them to agree or not with the spending priority.

it is undeniable he had the time (ie not an emergency) to have Congress debate this. He just lost the vote and is trying to find a way around that loss.

You really should try to understand the issue if you are going to continue to speak on it.

From an article in The Atlantic (not exactly a conservative publication)...I don't see any reference to "time must be of the essence!" He has the power as POTUS (granted by Congress in the Act!!!)...you just don't like it because it is President Trump.

Aiming to rein in this proliferation, Congress passed the National Emergencies Act in 1976. Under this law, the president still has complete discretion to issue an emergency declaration—but he must specify in the declaration which powers he intends to use, issue public updates if he decides to invoke additional powers, and report to Congress on the government’s emergency-related expenditures every six months. The state of emergency expires after a year unless the president renews it, and the Senate and the House must meet every six months while the emergency is in effect “to consider a vote” on termination.

By any objective measure, the law has failed. Thirty states of emergency are in effect today—several times more than when the act was passed. Most have been renewed for years on end. And during the 40 years the law has been in place, Congress has not met even once, let alone every six months, to vote on whether to end them.

As a result, the president has access to emergency powers contained in 123 statutory provisions, as recently calculated by the Brennan Center for Justice at NYU School of Law, where I work. These laws address a broad range of matters, from military composition to agricultural exports to public contracts. For the most part, the president is free to use any of them; the National Emergencies Act doesn’t require that the powers invoked relate to the nature of the emergency.

Trump ha been going after this. I know it wasn’t on the news today but this has been addressed several times
