Even over someone who never violated US immigration law?

Yes, and I'll tell you why. I agree with you that, logically, someone trying to immigrate to America the right way doesn't deserve to be cut. There's two reasons why I think giving a an illegal who self deports preference for coming back:

1) It's a good incentive to get them to self deport and do the right thing. Saves the U.S. money and shows that they want to sincerely be productive members of society.

2) As the left argues, many have families and established careers already. I don't believe immigration is a moral issue, but there's areas where we can morally do a good thing for ones who aren't in the U.S. for bad reasons. This is a good way to throw a bone to people who are pro illegal immigration and get them on board.
