Seems that the complaint is that the recruiters failed to send her application, which is fair. Like even if you know she's going to be refused, you have to send it, you can't just decide on your own. Even moreso when you know you're dealing with a lawyer. Of course she's suing, it's what angry lawyers do.

Recruiters do not have to submit every waiver. It is 100% at the recruiter’s discretion. If I don’t think the waiver will get approved, I will not waste my time.

Probably not, especially since she's not prior service, but a 42 year old dude in the Guard was allowed to go through SFAS and is currently serving with 19th SFG.

My brother joined at 33 and aced his PT tests. Perfect score. Of course, we are of a superior stock, but it shows older people can perform just fine.

33 is not bad but I think if he had went to BUDS he would have felt that age on him fast. It's possible he could have gotten through but the odds are very slim.

Every branch has different age requirements. Age requirements also change from time to time based on the needs of the service. I was a National Guard recruiter from 2008-2011. If i remember correctly, back then you could enlist and had to ship to basic by your 42nd bday. I’m sure that has changed a few times since.
