What that means in plain English is that the totality of the stop must be taken into account. Was the stop justified? Was the attempted detention legal? Did officers make an appropriate attempt to de-escalate the situation? Did the officers make every attempt to avoid "creating the threat" by putting themselves in the path of the vehicle? All of this is considered in Barnes v. Felix.

These officers seem to have attempted to illegally detain a woman that was protesting, escalated the situation, and created the very threat they are attempting to use as justification for deadly force. If this is the case, then this IS NOT a justified use of force, and they will be charged with manslaughter.

I think a lot of you are not seeing what happened.

The first shot did come from the front, as evidenced by the bullet hole in the front (that was likely the kill shot imo). The bullet hole is very close to the bottom of the windshield, likely 6-8". This confers with what is seen on video - ICE agent leans onto car with gun already drawn (his gun was low on windshield). He discharges it the moment she accelerates/starts moving forward. As she turns right and past him he puts two more in through the driver's side window (unsure if these struck or which bullet caused fatality out of the three).

The problem is that he wasn't supposed to do ANY of that, whatsoever. Every single action initiated by ICE in that video is in direct contradiction with their own operational policies and procedures.

It really doesn't matter where the bullet came from, it's irrelevant.....front, side, outer space. There should never have been any guns drawn in this situation in the first place. There should not have been an attempt by a federal agent to open a vehicle and detain a citizen for a state violation.
