Verbal or Written Consent for Sex on Campuses

In consensual sex, verbal consent is assumed. However, the girl can change her mind ANYTIME. I remember reading a case in law school about a girl and guy having consensual sex, they are in the process of doing it, she says to stop right when he's about to blow, he keeps going for a few more seconds, finishes. Boom. Rape. Guilty. A woman can say NO at ANY point in the encounter and no contract in the world would require her not to.

The law in the OP still allows that.

"consent must be ongoing throughout a sexual encounter, and can be revoked at any time. The existence of a dating relationship between the persons involved, or the fact of past sexual relations between them, should never by itself be assumed to be an indicator of consent."

So I guess you have to get consent beforehand, but then continually ask for consent every couple seconds to make sure it hasn't been revoked, but you have to ask in a way so that it's clear you're not pressuring her to give consent.

As someone said, though, this law changes nothing. Most hook ups happen with alcohol involved and, according to these same universities, consent cannot be given when drunk. It's still a game of "he said, she said" in favor of the "she."

And how exactly do they propose to enforce this law? Are they gonna hire Sex Police, a task force of moral young men who watch couples have sex and spring to action when consent becomes murky? How will the application process work? Would watching porn count as work experience?

The love contract. Now required by law on participating campuses.

Yeah, this law would backfire almost immediately.

or have Big John there to referee the whole thing and make sure the rules are followed.

"you ready? you ready? Let's get it on!"

So if you are drunk and forget to get the paper signed, you are automatically guilty if the girl decides to accuse you of rape?

If girls were smart, they wouldn't sign it anyway

I don't know about you, but I don't usually get a formal statement of consent in the middle of fucking sex. Just keep going unless you're told to stop.

muh rape culture

I wouldn't wait till the middle of sex.

This is America bro, you are not automatically guilty of anything

Consent SHOULD be ongoing throughout. My other half and I would be having words if he finished in me when I had a change of heart (which, could be for any sort of reason) and we're married. I wouldn't be calling the police but with a stranger I might.

I did this when I went to University, just to be safe.

doesn't California have "squatter's rights" ... lol, wtf;?

The general idea of squatters rights is not new as adverse possession has existed for years. Adverse possession is a very valid concept and useful. The problem with squatters rights relates to how short of a time period some states make it. I know I've seen 30 days in some states which is ridiculous. Adverse possession in my state takes 10 years and to my knowledge, there isn't a shortened time period for squatters rights.

Yeah, they allow for that. I've heard stories of people leaving their homes for months for extended vacations, going to take care of family members, military deployments, and such. Squatters move into their home, and when the owners get back, it can take weeks or months to get the squatters to leave the property. CA is an absurd state.

There should be a squatter app that lets you know whose leaving town and for how long

I ask again, who were you?

Weird how this got swept under the carpet. forgotten about.
