Alan Dershowitz Warns That One of Trump's Executive Orders Might Not Survive in Court​



Constitutional law attorney Alan Dershowitz is warning that one of President Donald Trump's Day One executive actions might not survive a legal challenge already lodged against it.


Shortly after he was sworn in, Trump issued an executive order—titled "Protecting the Meaning and Value of American Citizenship"—that tightens the grounds on which U.S. citizenship will be granted to those born in America.

In an episode of "The Dershow," a skeptical Dershowitz said that while he believes birthright citizenship was "a dumb idea," he doesn't think Trump can nullify it through executive action.


Hours into Trump's presidency, the American Civil Liberties Union (ACLU) launched a lawsuit over the executive order, arguing that it violates the 14th Amendment. Although Trump had considered ending birthright citizenship during his first term, he never issued an order on it until now.....

Executive Orders cannot modify the Constitution, and lot of times they can be unactionable and thus pointless (ie Trump's EO on gender that actually declared everyone female). EO's are directives for federal agencies and institutions, so one has to consider A) who is responsible for what is being addressed, and B) how can the directives be put into action and enforced.

It’s clear that you’re struggling with a major misunderstanding, and I think maybe it is “subject to” that you aren’t understanding. It’s ok, I am here for you.

These supposed “gotaways” are simply people who….wait for it…got away and evaded capture. That doesn’t mean they aren’t subject to our jurisdiction, they certainly will be if they are apprehended.
—You understand that US citizens do this too, right? A citizen can commit a crime, police get called, they flee and successfully (for the time being anyway) get away.
That has nothing whatsoever to do with whether they are subject to the jurisdiction of the police or of our laws. if they get apprehended, they’ll be charged, go to court, stand trial, etc. Same is true for undocumented immigrants. “Subject to” simply means that one is under the sovereign authority of the US in that they can be charged, tried, sentenced, etc. It doesn’t necessarily mean that there is a legal case happening at this moment.

Seems like a pretty clearly unconstitutional violation of their 1st Amendment rights and probably 5th Amendment rights too. Hopefully will get struck down quickly. We’ll see if Trump respects the courts’ decisions when it happens.
