Elections Trump Indicted On 91 Counts

as per tim pool, president has immunity from actions done as president (presidential duties, you chuds, you can't shoot random people), and if you want to charge him you have to impeach and convict first before filing any criminal charges, otherwise EVERY chud state prosecutor will charge any president for any reason any time they want.

although the cases and motions are very similar, donald trump tried to make the presidential immunity claim to judge chutkan in order to try to get his georgia election subversion state trial thrown out. of course it was denied and he is already trying to appeal that

what this new one is about is that cheeto benito was going to try to make the same whackadoodle presidential immunity argument in the jack smith federal case to try to get that thrown out as well, but he was gonna wait until the last second, just in an attempt to stall the trial for as long as he can. jack smith seen this coming so he's just gonna have the supreme court take a look at this potential argument and have a hearing and make a ruling over it just so that he can put their whole argument to bed before it can potentially delay their trial. in all likelihood this issue would probably end up getting looked at by the scotus anyways as the appeals courts arent going to want to touch this, and even the scotus probably wont take it up either as the constitution is pretty clear that a former president is still liable to be prosecuted for his crimes in a criminal trial, whether he was impeached and convicted or not.

but what this move from jack smith is going to do is put all that presidential immunity and double jeopardy shit to bed long before the trial begins, whereas in the georgia trial judge chutkan has already made her ruling and its still gonna have to go through the appeals circuits and possibly even make its way to the scotus as well because big baby butthurt is going to try to appeal everything if he doesnt get his way, and then keep on appealing when his appeals failed. he doesn't have a valid defense strategy so all he can do is buy for time, and what jack smith is doing right now is going to shut him down before he can even try to play that game. whereas in the georgia case, if they had a march trial date, this shit could very well jeopardize it depending on how slowly it moves along through the appeals courts before they rule on that and then trump appeals to the supreme court to delay that even longer. he's basically resorted to pussyfooting and using bitch stall tactics because he doesnt really have a solid legal defense for the crimes alleged against him and these kind of loser tactics is now what he's been reduced to.

I think getting fucked around by Aileen Canon in the FL case has really made Smith put his foot to the floor in this case, he is not messing about.
That part wasn't too surprising, but the fact that Scotus agreed to see filings and set a deadline of Dec. 20th for submissions within 2 hours of Jack Smith submitting was pretty amazing. I'm sure even Smith was a bit shocked by that turnaround.

I don’t know how one could even try and argue that these acrivities were within the scope of presidential duties. The Constitution is clear that the manner that elections are run, and the tallying of votes and certifying of electors, is in the purview of the various States. The POTUS has no role in this whatsoever, and that’s by design. This is hardly a case of, say, charging a POTUS with murder because of military actions they ordered as Commander In Chief— Presidential Immunity might make sense in that instance. What Trump was doing was altogether different.

Can you link me to the post or video or whatever of Tim Pool making this case about needing to impeach and convict before criminal charges can be filed? When I read that just now in your post, it made me do that thing dogs do where they cock their head to the side. I just can’t fathom where in the Constitution or law he’d get such an idea. Makes no sense.

the only way it won't be going to trial is the scotus takes up the argument and ignores the constitution and rules that whatever crimes he commited while in office is protected by presidential immunity or double jeopardy. these are both extreme longshots and not very likely to play out, but they are part of donnie's defensive arguments and he was surely going to raise that argument just to prolong his trial date while throwing out a hail mary trying to get the case dismissed.

if the scotus decides they dont want to take this up, which is a likely probability considering the constitution pretty much lays everything out and theres nothing here to really challenge, then nothing changes. it will still go to trial and trump will still try to use the whole presidential immunity and double jeopardy bullshit to try to have the case thrown out, but his frivolous motions will die in the appelate courts instead.

his only hopes is to stall this out and buy for time and then he would have to win the election and then pardon himself, get rid of merrick garland and all of the top DOJ guys and bring on a bunch of partisan trump loyalists just to drop the case against him just in case it somehow gets ruled that a president cannot pardon himself.

Also remember that a number of Republicans acquitted Trump not because they claimed he was innocent, but because they claimed a criminal court was the proper place for the matter.

If I remember correctly, many of them just said "so what?" followed by "who cares" while tacitly admitting he did what he was accused of...then they voted to acquit him.

They basically just said they don't care, arbitrarily saying "it doesn't rise to the level of impeachment"...which is a cop out, because we all know they would have said that about anything he might have done.

I’d say it’s a possibility. And not just because people might protest, but think of the unchecked power a president would have, and the things they could do. I totally understand that a POTUS can’t be concerned about being charged for murder for decisions they make as Commander-In-Chief of the military, for example; but if it was decided that a POTUS can essentially interfere in all manner of ways in the way states conduct elections, tally votes, or certify electors, we will be in some very deep shit. I don’t think that even this radical SCOTUS would decide that, it would be totally nuts.

Under normal circumstances, you are absolutely right, however, in this particular case there is a deadline, where if this case doesn’t happen in a timely manner, and Team Orange 🍊 is successful in delaying until the election, and IF Trump wins this case is shut down.

Btw...a lot of the information is already public domain, and it hasn’t persuaded MAGA one bit, they seem to be able to justify ANYTHING for the Orangina Antichrist.what they want is an actual verdict...for moderate/undecided voters.
