jack smith is playing some 5D chess here. and either the scotus will rule that a sitting president can break whatever laws he wants to while in office and a president is a king and then this case will fall apart, or donny dearest is about to have his only legal defense fall apart in front of his very eyes before he even has to drag his ass to court kicking and screaming.

Supreme Court agrees to rule on whether Trump can be prosecuted​


Special counsel Jack Smith had asked the top court to rule quickly on Mr Trump's claim of presidential immunity.

The request comes after Mr Trump sought a delay in his trial while an appeals court decides the matter.

The case is currently scheduled to begin on 4 March in Washington DC.

In a petition to the Supreme Court earlier on Monday, Mr Smith wrote: "This case presents a fundamental question at the heart of our democracy: whether a former President is absolutely immune from federal prosecution for crimes committed while in office or is constitutionally protected from federal prosecution when he has been impeached but not convicted before the criminal proceedings begin."

By doing so, Mr Smith was attempting to accelerate the time it takes for the US court system to review the former president's appeals - a process that can sometimes last for months or even years.

In a brief order, the Supreme Court said it would take up the case on an expedited basis and asked Mr Trump's legal team to file a response by 20 December.

Ahead of the top court's ruling, the Trump campaign had accused Mr Smith of trying "a Hail Mary by racing to the Supreme Court and attempting to bypass the appellate process".

"There is absolutely no reason to rush this sham to trial except to injure President Trump and tens of millions of his supporters," a spokesperson said.

I don’t see the point. If the scotus says he is protected, will they just drop the charges? Is he banking on them saying he isn’t protected, so he can’t take it to the scotus after?

it has huge ramifications because if they rule that private citizen donald trump is immune to being prosecuted for illegal shit he did while he was in office, they'll basically just throw this case right out. but if he's not immune to that shit, he won't be able to use presidential immunity as any kinds of defense, but most importantly as a means to file any motions to dismiss or appeal on a judges ruling and then drag this out for months or even years before the trial can begin.

trump was gonna sit on his hands until the last minute before trial and then try to motion to have his case dismissed based on the grounds of presidential immunity, and then probably even double jeopardy reasons too after all of the presidential immunity shit gets struck down by every level of court in the land. it could have potentially tied up the trial dates for months or even years, mostly depending on how slow things move through the appeals courts and how long the SCOTUS would have taken to decide on the issue.

this is a high risk-high reward play right now. if it pays off, this will flatline donald trump's legal defense and completely fuck over his stall game he's trying to play and it won't jeopardize the march 4'th trial date. but if jack smith craps out they'll probably have to throw this case out.

jack smith has to be confident in his arguments to want to bring this argument straight to the scotus. but lmfao @ his efforts to bury cheeto benito's 2 legal arguments before he even has a chance to show up to court and make them. that's some 5D chess right there. i like this move very much.

WASHINGTON — Special counsel Jack Smith on Monday asked the Supreme Court to immediately step in to decide whether former President Donald Trump has immunity from prosecution for his actions seeking to overturn the 2020 election.

"This case presents a fundamental question at the heart of our democracy: whether a former President is absolutely immune from federal prosecution for crimes committed while in office," Smith wrote in the court filing.

Smith said it was "of imperative public importance" that the high court decide the question so that Trump's trial, currently scheduled for March, can move forward as quickly as possible...

On Dec. 7, U.S. District Court Judge Tanya Chutkan, who is presiding over the election interference case, denied Trump's motion to dismiss his indictment on presidential immunity and constitutional grounds, prompting Trump to appeal and ask for the case to be put on hold.

In order to prevent a delay, Smith is seeking to circumvent the appeals process by asking the Supreme Court to take up the case and decide the issue on an expedited basis.

Smith asked the court to order Trump to respond by Dec. 18 and then immediately act on his request. Under the timeline proposed by Smith, the court — if it decides to step in — could hear arguments and issue a ruling in a matter of weeks.

This is a brilliant legal move. If the SCOTUS rules Presidents are forever immune to prosecution, no reason for the current administration to ever relinquish power.
