They can be both, and in the case of Haitians, they were working legally until Trump came home.

But that's beyond the point, the economy doesn't gives a shit about the legality of the guy spending 8 hours killing and plucking chickens, it only follows the laws of offer and demand, and labor is just another commodity, these hands won't be replaced by Americans at any given price point, the market will adapt, either by shipping these jobs away, closing down production or raising prices.

Whether that's "good" or "bad" its all up to subjective opinions.
