I'll be curious to see how this all shakes out, especially as I'm not really knowledgeable about criminal law in Ireland. In the US typically you can't be charged with perjury if you withdraw the false statements prior to the conclusion of the trial.

Conor McGregor’s appeal of being found civilly liable for sexual assault last year has taken an interesting turn.

According to a reports from BBC.com and the Irish Mirror, the Court of Appeal hearing concluded on Wednesday, with a full decision expected at a later date. Perhaps the most noteworthy happening occurred when McGregor’s legal team elected to withdraw what would have been significant evidence in his case at the beginning of the appeal on Tuesday.




This past November, the former UFC two-division champion was found civilly liable for sexually assaulting Hand at a Dublin hotel in December 2018 and ordered to pay the victim nearly $260,000 in damages. During the civil case, Hand alleged to have suffered a number of injuries on her body from the encounter, including bruising.

The aforementioned evidence in the McGregor appeal came from Samantha O’Reilly and Steven Cummins, who were former neighbors of the victim, Nikita Hand. They alleged to have witnessed an altercation between Hand and her partner on the same night, prior to her meeting McGregor. During a preliminary hearing it was suggested that the bruising on Hand’s body came from that dispute rather than McGregor. Hand denied the claims and was prepared to take the stand as a witness during cross examinations.

Evidence Withdrawal in McGregor Appeal Surprises Judges​



However, the proposed new evidence was withdrawn by McGregor’s legal team on the grounds that there was no corroboration from the witnesses. According to the report, the judges on the appeal panel did not understand why the decision was made. Meanwhile, Hand’s lawyer demanded an apology for being “put through the wringer” regarding the evidence, which had already been made public in the media.

As a result, Hand’s lawyer requested that the Court of Appeal refer the matter to the Director of Public Prosecutions, which will determine whether perjury occurred and if any of the involved parties could face criminal prosecution.

McGregor did not appear at the appeal hearing.

Their claims have now been totally withdrawn by McGregor - with Ms Hand's Counsel seeking an apology from him over the ordeal. It comes after Mr Gordon had asked the Judges yesterday that the court “ought to allow me to cross-examine Ms. O'Reilly and her partner and Mr. Staines and then refer the matter for perjury proceedings to the Director of Public Prosecutions and subornation of perjury against Mr. McGregor.”

Reserving their judgement on McGregor’s actual appeal, main Judge Isobel Kennedy said she was referring the matter to the DPP. The DPP will examine whether any potential perjury has occurred and anyone found to be suspected or that could face criminal prosecution.

But then later:

The couple had sworn affidavits claiming they heard a row between Ms Hand and her then partner on the night of 9 December 2018, after the alleged rape, with Ms O'Reilly claiming she saw the row from her bedrooom in a house across the road.

She claimed Ms Hand's then boyfriend pushed her and she saw him moving his arms and hips as though he was punching and kicking her.

Mr Cummins had claimed he was woken by screams and shouts coming from Ms Hand's house but said he did not see what had happened. Their claims were been totally withdrawn by McGregor on Tuesday - with Judge Kennedy criticising the “last minute” move.

But then it returns to:

He indicated that he had intended to cross examine Ms O’Reilly on the contents of that documentation before her evidence was withdrawn by McGregor.

He told the court that the claims made by the couple had been opened in court and widely reported in the media - claims that McGregor’s side he said were now conceding were “lies.”


So the responsibility seems to be pointed in multiple directions at different times
Right, they're saying the couple lied in the affidavit but McGregor asked them to do it, which is the subornation of perjury charge.
