If we have Birthright citizenship, why the need to pass the Indian Citizenship Act of 1924?
 
The EO is guaranteed to reach the Supreme Court
Why is it guaranteed to reach the supreme court? A lower court knocking it down as clearly unconstitutional and no higher court taking it up because there doesn't seem to be an argument in favor of the EO would end it before the SC right?

I think given the popularity the discussion on immigration has been lately, I think this is the new or next Roe vs. Wade issue to divide the country.

Because native Americans are effectively members of foreign nations in the eyes of the constitution. Something orignalists always forgot for some reason.

That's how most Americans gained citizenship through history. Land in America, have kids, be Americans.
 
You can just admit you don't understand the Constitution instead of flailing around.
A child born in this country has no allegiance to the US just like their parents.

can’t you appeal each level? They might just shoot down the case but that would still be some announcement they won’t hear the case on the last appeal.

Edit: looks like normally it would just die. I assume with presidents, they generally take it up due to the significance at the lower levels but that would be something if they just stopped it early.
 
The children of illegal aliens born in the United States are citizens of their parent's home country. The parents were never permanent legal residents. The parents are under jurisdiction of their home country
