Youth and more so violent youth crime seems to be getting out of hand.. personally i would have thrown away the key on the first charges..

A Melbourne teenager who was previously found not guilty of murder because he was 13 years old has appeared in a children’s court over a sickening alleged act.

The boy, now 16, who cannot be named for legal reasons, appeared before a magistrate on Thursday facing a string of charges over the bashing, stabbing and shooting of a 60-year-old man in Gladstone Park in July.

The teen who escaped a murder charge had 44 prior charges when he was 13 years old.

The 16-year-old was 13 at the time and was found not guilty of murder despite footage of the attack showing him stomping on Cutler’s head repeatedly while others stabbed him and returning to stomp on his unconscious body a second time after the first frenzied attack ended.


Common law presumes that when a child is under 14, they lack the capacity to be criminally responsible and the onus is on the prosecution to prove otherwise.

The rule is known as doli incapax.



Im guessing ee are about to have a few more child murderers here which is why i ask the question



Seems ulterly pointless to allow them back into society.. the first kid they gsng killed was stabbed 20+ times and had over 60 blunt force injuries..

By the initial sounds of these new youth gang stabbings. The numbers will be absurd again and i fail to see how murder isnt murder
 
Canada is sooooo bad for this right now. The youth 14-18 are out of control. As much as you want to slap the ever loving shit out of some of these kids they carry knives guns and are more then willing to use them. It's utter madness.
 
Should be held as an adult and get life.

I'm going to guess thats not going to happen and the very most he can get is held until he is maybe 21 and then let go.

Sweden have seen several teens commit murder and all they get is 4 years in a frat house with video games and internet, and the doors arent even locked.

There was a reason for that amd why it's changing.
 
there are a lot of traps in this conversation. Yes there are times when killing is justified. But you cannot disregard the loss of life of it is taken by a youth. The politicians and judges are responsible for the lives lost to these youthful murderers

Yes, it's much easier to have good crime stats in a country with roughly the population of NYC. They don't have nearly as many bad criminals and can have much more focused rehabilitation programs for those who ARE in prison. The people I worked with in US prisons who also had worked in prisons in Europe and Japan pretty much said the same thing- the programs were better in those places, but there were better conditions for them because the prisoners weren't as bad in general; they would not realistically work in most of the US for the most part.

Sweden is starting to move in the direction of the US with the gang violence because they are becoming more populous and diverse LIKE the US.

I hear you and respect the position, but when we are working with percentages, I’m not sure if I see the difference between a big country and a small one.

It feels like a chicken and the egg situation- our prison population act a certain way because of how they’re treated? Or do we treat them a certain way because of how they act?

Either way, there is no arguing that by the numbers what we are trying to do here in the United States just isn’t working. We incarcerate more people than anybody else in the world, our recidivism rate is through the roof, and there are people actually profiting off of this who are using those profits to purchase political sway directly through politicians and unions.

Well Sweden are in talks with Estonia, they want to rent prisons there to house criminals.
Even the left are starting to get interested.

Which ? The victim or the perpetrator?

Because the perpetrator is " unknown " due to his being a " child ". They need protecting

But hes a sudanese australian.. we have been trying our best to ignore their over representation in violent crime ... especially youth kinfe crime for years in australia. And people die for it ...

Often its the innocent sudanese australians or minorities who arent pieces of shit like the perpetrators unfortunately.

the recent kids killed in melbourne ( 12 and 15 were hacked apart by a machete welding group of 8... ) 5 killed the 15 year old. 3 chased and killed the 12 year old from what i can tell. Just kids returning home from basketball with mates.


Pretty similar mo.. large group. Frenzy attack.. and top tip. If it was 8 white guys machetting down sudanese kids on ctv. It would be global news.

But.. theres a tonne of youth now rocking machettes and knives in melbourne . Its not exclusively a specific ethnicity issue. Despite the over representation of victims and perpetrators in certain groups its a growing issue. Probably because it hasnt been adressed properly for fears of being racist and creating more complex " social issues "...

Kind of the same reason youth crime is nuts in nt and nq ( north queensland and northern territory ) because it would create some awkward conversations... once again. So people just ignore it the best they can. The media avoids it on a whole and the law ignores it and the judges excuse it.

yet dont address it... and shit ends up far far far far worse. Inevietable
