I'd like to note a few differences - Daley went up to him and legit punched him, and this was being completely coherent.

You just saw Silva moments before get face planted from a spinning elbow, then pummeled with follow-up. He was most definitely concussed. Diego approached him, which was likely a bad idea.

Daley was being a crybaby with clear eyes and if you are unaware, Silva did that protesting that Diego hitting him with illegal shots (back of the head) which is what he was saying, complaining he was dirty in that last sequence.

He's going to get a warning but not the Daley treatment and I think there are enough mitigating factors where that makes sense.

Also want to note, it was not getting hit in the back of the head that led to the stoppage, Silva wasn't getting out of that.
