Wanderlei Silva gets lifetime ban

My Lexis access doesn't cover Nevada, and Google isn't helping much. Here's the rub: If Silva wasn't licensed at the time, he may be able to argue a lack of jurisdicition. It really depends on how the statute reads.

Interesting. He may well be able to make that argument. I hope he does. Even if he stays retired, he should have that blemish removed from his record. He's a legend and shouldn't be shafted by the NSAC like that.

Did they even have the jurisdiction to test him? He should not have run away, definitely. But I'm wondering about their jurisdiction here, since they seem to have granted themselves a whole lot of authority (including outside the US for fighters not currently licensed with them).
 
"A fighter showing intention to fight" simply has to be enough if there's going to be any serious effort to address PED use. Fighters need to be able to take fights and be licensed on short notice, or injuries would completely wipe out most cards rather than merely degrade them like they do now, but if fighters could just tacitly commit to a fight months beforehand and then not apply for a license until a week before the fight and thereby avoid pretty much all in-camp testing that would amount to a loophole that would effectively end enforcement.

Instead of "licensing" fighters the way they do, for single bouts, the commission should have some kind of contract, permanent license, or anything like this, that gave them the right of testing fighters whenever they wanted. It's more of a flaw in the commission's system. Nothing wrong about having jurisdiction over fighters when they're not fighting. But it must be clearly stated somewhere, and not based on "it seems he's gonna fight".
 
i think the lifetime ban is a little harsh. but i guess it's just a ban from fighting las vegas. he isn't suspended from fighting anywhere else that would grant him a fight license.

NSAC is just like NFL's goodall. they either do nothing at all or they go overboard.

But he was in Las Vegas promoting the fight. They certainly have "personal jurisdiction" over him, the question is whether the legislature intended to give the NSAC authority over fighters that have yet to actually receive their license. I doubt Wanderlei will prevail on this argument, but you never know.

He wasn't promoting the fight in LA as far as I'm aware, nor had he applied for a license yet. If we are to believe Chael, he hadn't even signed the contract for the fight(keywords: If we are to believe Chael).
 
chael,overeem,bigfoot,etc,etc all these guys get a suspension but wanderlei gets lifetime ban?? what a joke.
 
wand did this to himself by running away. if he had just pissed hot he'd just be suspended for a year most likely.

he'll always be a legend of the sport, but the fact remains that he fled a random drug test. i'm not defending the NSAC's lifetime ban or the fine (good luck enforcing that) but you have to expect you'll be punished severely for pulling a stunt like that.

Bullshit decision. Give him 2 years (which is still harsh) at the most and then announce "From this day forward if you run you will have a lifetime ban"

I love Wand as much as the next fan, but I believe he is the first to actually run from a drug test in history. Correct me if i'm wrong. That isn't behavior you want to encourage. Oh shit, i'm gonna piss hot! oh well, i will just not go.

Especially after the Overeem ruling too. Actually wouldnt be surprised if the UFC has more sway over NSAC now that Kizer isnt there and after Wanderlei's video

By its definition sure, but in the context he used it incorrectly. Wand simply rolled all his beef into one beefroll and fed it to the UFC/NSAC/haters in one shot.

PEDs are a part of the fight game. The UFC forces its fighters to train hard and fight, to the detriment of the fighters' health and well-being, while paying them pennies. So they take PEDs so they can recover, train, and perform. Then they get in trouble with the ACs and the UFC throws them under the bus for being cheats or for not making weight.
 
Had Wand not announced his retirement, they would just give him one or two years. TS faked his test, which is as grave as running from NSAC, if not worse, and just got one year.

Since Wand won't fight anymore, it doesn't make much of a difference and they don't need any mercy.

Now... how enforceable is the fine? It would be funny as hell if Wand decided he "misses Brazil" and dodged the fine too.

I'm not in anyway suggesting that running from a drug test should go with no penalties. It most obviously should, and very stern penalties.

Banning Wand for life is nothing short of a joke. I have absolutely no faith this new NAC has any idea what it's doing.
 
The issue here isn't that they were too harsh on Wanderlei. People who run from test should receive an indefinite ban.

The issue is that Overeem, Sonnen, etc weren't dealt with harshly enough. Both Chael and Overeem should have received indefinite bans, as well...and I've swung from both of Sonnen's meaty clackers...
