Might have something to do with evidence? Maybe if they used evidence from during his presidency it falls under the immunity? Thats all I can really think of.

It still would make no sense. Just because evidence was found while he was king, sorry president, the crime was still done before he was president, correct?

Joking aside: I have no idea. I suspect they will still reach the same conclusion as they did in the original trial, but they want to take the time to ensure they do everything correctly. And thus leave Trump no avenue of appeal.

It would compromise the prosecutions case because the evidence would fall under his immunity. It’s less to do with the crime and more to do with the evidence itself. Again, purely speculative on my end.

The decision was made by the New York appeals court in Manhattan. According to the filing, the court determined Giuliani knowingly lied about the election, including claims about illegal voters being bused from out of state to vote in Pennsylvania’s election, and that a vote was cast by deceased boxer Joe Frazier. The filing also determined that Giuliani pushed a raft of other baseless claims — like his allegation that thousands of noncitizens cast ballots in Arizona — that lacked reputable evidence.


The court said Giuliani must “comply with the rules governing the conduct of disbarred or suspended attorneys.” It certainly marks a fall from grace for a man who was once billed as "America's mayor."

Thats a lot of time, must be something substantial that needs to be considered and looked over.
Actually for the courts that’s a relatively quick turn around..

I played a MSNBC clip in the thread about immunity explaining the issues. A lot of evidence the state used involved press statements, twitter posts, etc that Trump made as president about both Cohen and Daniels.

Technically, that evidence can no longer be used. Maybe a mistrial?

How funny would it be that the prosecution trying to submit a bunch of evidence that didn't even really have to do with the actual case, to smear Trump, that the judge allowed despite objections, is the reason this case gets tanked.

It wasn't in the ABC article, but in the CBS article, Merchan said, "In a brief response, Merchan approved the proposed schedule and wrote that he'll render a decision on Trump's motion on Sept. 6. He set a new sentencing date of Sept. 18, "if such is still necessary."


edit: regardless, the most significant part is Trump will be free to campaign all summer, through the second debate. I thought Merchan was going to send him to jail, but if not, probably would have done house arrest, keeping Trump from campaigning, even perhaps keeping Trump from the convention this month.

No. You can't retroactively declare a mistrial. Maybe in russian courts. Not American ones.

Best Donny can do is hope to appeal this conviction and raise the recent immunity ruling. I don't see how he could claim altering business records to hide his affair with a porn star before he was president, is now protected by the immunity afforded to a president.
