By the very nature of him being able to talk about it being a 'national emergency' for now months on end, proves its not a 'National Emergency' in the way the powers are granted.Supposedly that is what he may think about doing in 3 weeks. I would love to see how that goes and I don't think it would bode well for him. Not getting his way on the border wall is not a national emergency at all
There are 'separation of powers' for a reason. the Constitution wants checks and balances on a POTUS. The Congress has budget power by design. Its not an accident.
But the framers of the constitution could foresee situations of Emergency where a POTUS would need an exception to act fast (such as natural disaster) and where the POTUS would not have time to seek Congressional support. So the powers of Emergency are very limited and very clear.
By the very virtue of Trump delaying the declaring of this emergency by months, since he first brought it up as an option PROVES it is not an emergency aand he could indeed bring it to Congress and seek funding the proper way.
The Emergency Powers are not intended to help a POTUS get around a Congress that does not agree with him and is properly using the powers of check and balance. And there is no way for the supreme court to agree this is an emergency when the POTUS himself has sabotaged that line by not calling it the first time he mentioned it.
