Law THE POLICE SHOOTING/USE OF FORCE MEGATHREAD: discussions to determine if justified or not

Then why tell me what you claim she told you. Presumably, she told you that in confidence in a private conversation. Why would betray the confidence of a private conversation, by mentioning the details of that conversation to me? That account also messaged me, and didn't say anything remotely like what you are claiming she said.

Again. I'm here for honest discourse about whether police shooting at Kyrie Anna Liles is justifiable or not. Whether the shooting is justifiable or not, depends on the whether the detention of Ms. Liles is lawful or not.

If you are no longer interested in that honest discourse.......you do have an ignore button.

I didn’t betray that conversation or the details aside to state that she pretty much agrees you are a lowly creature because of your past actions. I can’t recall if revealing private communications is an offense around here, and I don’t divulge the content of the discussion except that one comment, but I am sure if it is against the rules, you will report me like you tried to get me banned earlier, even calling mods in here in attempts to do so. You do have a heavy report button finger just like braklis did. And yes, I have had mods tell me that. As to which mod, that was a private conversation and I won’t divulge that.

Here you have been making comments non-stop about my issues, called her daughter crazy Harley Quinn while she clearly was in a mental crisis. And no discussion with you is honest discourse. I have no desire to discuss anything with you, but I am not hitting ignore because you will absolutely run your mouth behind my back and try to defame me.

So, once again, fuck off and fuxk yourself with a pineapple. I will even let you decide which end you start with-the wide one or the spiky one.

So, once again, fuck off and fuxk yourself with a pineapple. I will even let you decide which end you start with-the wide one or the spiky one.

That's not honest discourse to determine if a shooting is justifiable. That's more like a graphic confession of your sexual perversions, which I'm not interested in, and likely violates forum rules anyway.

Honest discourse about the Kyrie Anna Liles shooting is a discussion about voluntary police encounters vs investigative detentions, also known as "stop and frisk" or "Terry stops."

Terry V Ohio is rote, it was covered on School House Rock, and 9th Grade Civics. United States v. Mendenhall is a case that discusses how a consensual police encounter can turn in to an unlawful Terry stop through things like intimidation.....and physical contact. I recommend reading, and comprehending it. It's required reading to have honest, intelligent discourse when discussing voluntary investigative encounters that escalate to violence.

As I said, done with you: but I will say that you’re such a dick that the mom messaged me, a retired cop that doesn’t agree with her daughter’s actions over a cheerleader for her side. Why? She agrees that you are a dick and would rather not converse with someone like that. lol. Some defense attorney

You sure about all this? Because Batgirl left you a frowny face reaction to the post.

So what say you @nhbbear , with your active imagination, can you come up with a reason why the searched the house? Did the warrant read like this:

"On the morning of xx/xx/xx, Officers determined that no crime had been committed with a knife. We don't believe it was used in the commission of a crime, but We would still like to gain access to her house to look for (wink wink) kitchen knives."

Or do you think they stretched the area she was arrested in all the way back to her house and performed a warrantless search on the house incident to being arrested there?

Andrew Spencer. January 2024, Philly pa

January 26. Officers in routine patrol were looking for a suspect involved in a non-fatal shooting. Officers entered a store after being notified that there may be an armed subject inside and zeroed in on 28 yr old Andrew Spencer, who was a convicted felon with a firearm. As officers try to pat Spencer down, a scuffle ensues and it ends up on the ground where Spencer shoots an officer in the leg. The officers then return fire, killing Spencer. During the scuffle and after the officer was shot, the gun is kicked away and is then picked up by some dirtbag that hides the gun and exits the store leading to the familiar cries that Spencer was unarmed when he was shot. The men were yelling at police for shooting Spencer despite him shooting first. Video proves otherwise.

The calls of “justice for spence” started almost immediately with protests and marches and calls for action as is expected when a shitbag gets shot by police. Spencer had a felony drug conviction in 2016 and a “troubled history with law enforcement.” He also committed felonies in 2019 and 2020. With DA larry krasner at the helm, it is expected that he would serve little time for those additional felonies, though what those were wasn’t listed.

In what is called an odd turn of events, krasner and the police chief held a joint press conference and stated they are both investigating the incident in attempts at transparency. Knowing krasner, he will charge the officer for shooting Spencer.

I have a strange feeling you're not telling the truth here.

As for that woman's case, I wouldn't have been against initially forcibly removing her from the car. It's hard to say from the footage but it didn't look like she was trying to hit anyone. She was in an agitated state and trying to flee. I don't think shooting at her was justified.

Telling the truth about what, exactly? Being done with dickhead? I try, but he keeps tagging me. He’s like an annoying little brother that wants his ass beat and complains when it happens, but he keeps initiating it.

As for the shooting, I had an issue with them continuing to fire after the threat was already passed, however, I can see an argument for TN v Garner that they could say they thought she would run someone else over. And she could have driven away without veering towards the officer the slightest bit. As for the use of deadly force, all that matters is what those officers thought at that exact moment in time without using 20/20 hindsight. Would a reasonable officer think she was possibly going to continue to veer towards him? That is the question, and who is going to take that chance that she is not based upon her behavior? She could have continued straight but at the tree starts to turn right in almost a circle in the direction the officer is running.

She was completely whackadoodle from her calls to dispatch to her knocking on neighbors doors and going into their backyard with a knife. Dick is of the opinion that the officers never had the right to pull her from the vehicle. I disagree totally, but he and I don’t agree on much of anything other than we each hate each other.

I mean what her mother (assuming that's actually her) said about him. I have no interest in getting involved in your guys' affairs but I wouldn't use the mother as a pawn in that game. Regardless of what she said, keep private messages as private messages.

I agree that they had the right to remove her from the vehicle given everything that had transpired. I also agree that once she had passed there was no reason to continue shooting. That was a mistake.

After watching it a couple times, it's still too hard to tell exactly what she was trying to do when she was pulling out. Only those who were there know for certain. Everything happens so fast that it's just too hard to say.

Coward! You literally have zero self awareness. Here you are once again using adult language to make childish insults....behind my back. If you are going to insult me, tag me. Don't throw a rock at me from the safety of the bushes, and then run off crying about how rough I play when I retaliate.

As for the shooting, I had an issue with them continuing to fire after the threat was already passed, however, I can see an argument for TN v Garner that they could say they thought she would run someone else over.

Zero. That's the amount of force that is justified during a consensual police encounter. Which is what this started as. Investigative detentions require RAS, per their own words, they didn't have that.

As for the use of deadly force, all that matters is what those officers thought at that exact moment in time without using 20/20 hindsight.

Doesn't this same standard apply to RAS? The totality of the circumstances as articulated by the officer without some internet rando with a cop fantasy using 20/20 hindsight months later?? 1 minute prior to trying to remove her from the vehicle forcibly, the 2 shooters conclude; "No trespassing, no crime, no 417"( unlawful brandishing since you can't be bothered to look up policy or code). By their own words, they did not have RAS

That is the question, and who is going to take that chance that she is not based upon her behavior? She could have continued straight but at the tree starts to turn right in almost a circle in the direction the officer is running.

Zero bullets impacted the front of that car. The full bodycam shows that officer was NOT in the path of the car when he drew and fired his weapon the first time.
It wasn't self defense, it was retaliation for this girl succssfully resisting a false arrest.

She was completely whackadoodle from her calls to dispatch to her knocking on neighbors doors and going into their backyard with a knife.

You calling someone whackadoodle is quite rich since you've been begging for sympathy for your own mental and physical health issues for months now.

Dick is of the opinion that the officers never had the right to pull her from the vehicle.

They didn't, and the unedited body cam proves it. Captured on 3 separate bwc's. How "whackadoodle" do you have to be to cling to the idea the officers had RAS after hearing them say that they did not have RAS?

we each hate each other.

Don't pair me with your ugliness. I don't hate a Human on this planet; and I've been wronged far worse than some anonymous guy on the www making childish insults.

p.s. examples of your childish insults. These exclude you from any future claims you may make about maturity.

Hey, what do you call a quad amputee laying on the ground? Matt. So, fuck off matt

I get it, it was probably removed with the rest of you, anakin

t I pointed out that you are like anakin skywalker missing limbs and on a respirator, wearing a black suit.

You’re going to fuck around and upset the few working organs you have left and they’re going to quit on you too

btw, I'm not an amputee quite yet, I just threw that line in the water to see what I'd catch.......turns out it's a good bait for juvenile blowfish.<45>it's still non-fiction, I just "pumped up" the story like a pro once taught me.

Yeah, those last few ones were good ones. It’s funny that you like to call what other people say as fiction when you are doing exactly what you blasted others for. And it’s really funny that you call someone a coward for not tagging you when you did it many, many times in this thread making snide comments, insults, accusations. You and I will never agree. It’s pointless to argue with you. All we end up doing is trading insults. So once again, fuck off

I agree with you. I shouldn’t have brought her into it, but I didnt start the conversation, I was messaged. Like I said on the last part, when she swerves around that tree, I think it is clear those officers thought she was going to hit him with the car. When she is driving away from that point, they shouldn’t have fired.

It's your thread, why should I need to tag you? Have you even read the forum rules? Or you couldn't be bothered to?

-Post replies in your own thread. Don't just post and abandon it. Keep addressing what others say.

You and I will never agree.

So disagreeing with me is more important than understanding the law in regards to investigative detentions? The officers in this case literally say "no crime has been committed." They admit to not having RAS. The consensual encounter ended the moment she closed her car door, and the false arrest started the moment the incompetent cop reopened it. Cut and dry.

It’s pointless to argue with you.

It's pointless to argue with me about Terry or Mapp without having a strong understanding of investigative detentions, or the exclusionary rule. You've repeatedly proven that you in fact do not have a solid understanding of either.

All we end up doing is trading insults. So once again, fuck off

You have the Dark Triad in Spades 'bro. Wish you well with that, my friend.

Leonard Cure, Oct 2023, Camden county Georgia

This one is as fresh as it gets. Last week, leonard cure, who was wrongly convicted in 2004 of an armed robbery he did not commit. Cure got a life sentence based upon previous felonies and armed robbery convictions.

Last week, he was pulled over by Georgia trooper for driving 90 past the trooper in 70 mph zone. He then increased his speed to over 100 mph before pulling over. The trooper is loud and immediately tells cure to exit the vehicle and head to the back of the truck. Cure is sort of compliant but keeps pausing, leaving the trooper in a dangerous location with speeding traffic only feet away(this is a very important aspect to be examined later). Cure is incredulous when he asks why he was pulled over and the trooper says for speeding. Cure responds with something like “so what” and demands to know by what authority the trooper has to pull him over. Trooper calls for backup stating he has a non compliant subject.

At this point, things quickly head south as the trooper tells cure he is under arrest. Cure says he’s not going back to jail and the trooper tells him that traffic offenses are criminal offenses and then threatens to taser him, which he then does, with no response from cure who then rips the wires from him and starts flailing his arms at the deputy. The two begin to scuffle on the side of the highway and cure strikes the trooper and then begins to choke him and bend him backwards over the bed of the truck. The trooper then pulls out his baton and begins striking cure who responds “yeah, bitch!” When the baton strikes fail to achieve the desired response, the trooper pulls out his firearm and shoots cure under the armpit in a fatal wound. Trooper calls out shots fired and when backup arrives, he begins to treat cure to no avail.

The response was pretty much immediate in the media and activist circle. My favorite celebrity ambulance chaser, ben crump, is hired by the family and he states the following: “
NPR front-loaded its report with emphasis on Cure's exoneration, his race, and a quote from his family's lawyer, Ben Crump, claiming, "It is god awful that he would escape that injustice to have his life claimed by more bias. ... Just because you're Black should not be the determining factor whether you get a death sentence for a traffic stop."

SPLC president Margaret Huang said in a statement, "No one should be shot to death during a traffic stop. ... The brutal and unjust violence Black people have endured at the hands of police must end. Enough is enough."

"The SPLC once again calls for a reimagining of policing in this country that respects the rights of all people," continued Huang. "Leaders at every level must take urgent action to end the culture of anti-Blackness in policing, keep all communities safe and demand accountability until equal justice is a reality for all."

Look, it really sucks that he was falsely convicted and good on the innocence project for proving he was using an atm far away from the scene of the robbery when it occurred. And it also sucks that he was not fairly compensated, only getting 800k for sixteen years of hell, however, his actions on that day were very violent and dangerous and this shooting was absolutely 100% justified. Cure was traumatized no doubt, from being caged for 16 years and however long he was in prison for his previous armed robberies. Dude was definitely traumatized at the thought of going back to jail/prison and this triggered his fight/flight (almost entirely fight) but any person, regardless of race, that chokes and strikes a cop on the side of a busy highway is getting shot when all other lesser levels of force fail. I wish the trooper had come in a little cooler and explained to the guy, based upon PA v Mimms, that the trooper has the right to have the driver or passenger exit the vehicle for safety reasons. My thoughts on this are that it is unsafe to conduct a traffic stop on a busy highway with vehicles traveling in excess of 70 mph. I also think that part of the yelling from the trooper was both stress and the highway noise. If you’ve never been on the side of a highway, two things that will shock you is how loud it is and how much the road shakes and the wind as cars whistle by. On bridges, it’s really bad. Regardless, a cop being a loud dick is one thing-resisting arrest and trying to choke him or fight where you could go out into traffic is another. I have been both parts of that. I have on one or two occasions, been the loud dick (seriously, only a few times because I remember and regret those times and my behavior and learned from it) and I have also fought people on the side of a busy freeway and it is scary af. Shitbag crump and the activist nation have been making this all about race because that’s their only play. This man was already a violent criminal before he was ever falsely convicted, so blaming this totally on that experience is not accurate, but it certainly didn’t help. But the ploys of race and calls for justice are only to generate anger and will scare people into paying him a lot of money to be an ambulance chasing chickenhawk.

The incident

Press conference where brother calls multiple convicted felon “a man of integrity” and crump and family are to meet with prosecutors to determine when/if charges will be filed against trooper.

Longer (50 mins) press conference by crump where he says cure was killed “by Jim Crow bigoted policing” “another black man caught up in racist criminal justice system” “we all know if he was white, he wouldn’t have been shot by police for a traffic stop” and then he blasts Facebook removing the live stream and he accuses law enforcement of having this done or accuses Facebook of doing it(very important because mark my words-crump will try to sue Facebook)

Giving this post about leonard cure and that incident because his family is filing a 16 million dollar suit against the officer and department. They claim excessive force and that the officer should have shot him somewhere less vital.

Ok, this one will be maybe a little more difficult to defend, but it is still worth discussion. But this one has been used to ramp up Breana Taylor 2.0 which occurred in a similar fashion, but the cases are also so different, that I question the intelligence or sincerity in comparing the cases. I will get to that later.

Amir Locke, Feb 22. St. Paul mn

Amir was asleep on a couch of his cousin’s apartment. Police entered using the dreaded no knock warrant like the one that killed Breonna Taylor-oh wait, the whole no knock aspect of that case is complete bullshit and the police knocked and announced but still, educated people like politicians and ben crump still blame no knock warrants for Taylor, which was a knock AND announce search warrant even though they had the ability to not knock per the warrant-but they decided to knock and announce, allowing Taylor and her bf to be in the hallway with a gun.

Anyway, police simply use a key to unlock the door, enter and begin shouting police search warrant!” An officer kicks the couch in an attempt to wake Locke up and he sits up and points a gun towards officers. He is shot immediately and dies.

But we need to back up a little bit. Why were police using a no knock warrant on this apartment? Well, because they were searching for the suspect who shot and killed 38 yr old man. You would have to look up his name or read multiple articles before you would read his name, Otis Elder, whom was murdered by Locke’s friend/cousin.

But but but Locke wasn’t listed in the warrant. Doesn’t matter. But when you are serving a search warrant for a suspect in a murder, you detain and id everyone in the house until you have your suspect or determine they are not there.

No one knows Otis name, but they know and protested the death of locke even though he pointed a gun at officers after being startled awake (he was a deep sleeper says mom). This is yet another time that black lives only matter when taken by a cop or white person-otherwise, no one gives a single fuck.

Here’s one aspect that really pisses me off. Use of force experts and activists noticed on the video or body cam that locke’s finger was not on the trigger and was down the slide. But guess what-that does not matter one little bit. If you’re an officer serving a murder warrant, you don’t ignore the guy on the couch because he’s not the guy you want. You secure everyone exactly for this reason. According to the fourth amendment (every police use of force is a seizure of the suspects/subject’s fourth amendment rights. And this is done using graham v Connor and tn v garner. Graham looks at each use of force from a reasonable officer’s viewpoint with only the info they have at that time. In other words, no 20/20 hindsight such as armchair QBs scouring the footage and seeing his finger down the slide. Sorry, you’re not allowed to do that.

No charges against officer, lawsuit filed but not settled yet.

Here’s the shooting.

Here’s the community response to locke, not elder because no one cares about his life.

Ok, this one will be maybe a little more difficult to defend,
WTF? You needed a minority murder porn fix so you dug through the archives? Locke's death isn't defensible, and only an idiot would think it was.

but it is still worth discussion.
The discussion to have is about warrants, and how to serve them while considering the balance between Officer safety versus the Gov't intrusion on, and safety of the Civilians they serve.

Here’s one aspect that really pisses me off. Use of force experts and activists noticed on the video or body cam that locke’s finger was not on the trigger and was down the slide.
Did it piss you off when the Police originally referred to Locke as a suspect? Because I don't see you beating that drum.

But guess what-that does not matter one little bit. If you’re an officer serving a murder warrant, you don’t ignore the guy on the couch because he’s not the guy you want. You secure everyone exactly for this reason.
You are basically justifying the death of a law abiding citizen as acceptable collateral damage for legitimate police work. Minnesota AG referred to Locke as a victim. The Mayor enacted a moratorium on "no-knocks", and subsequently banned them. MN also enacted greater restrictions on '''no knocks" because of this shooting.

Yet here you are with zero empathy for someone who died at the hands of the police, simply because he was sleeping at his cousins house. He was a victim of circumstance, wrong place, wrong time.

You using him to push your twisted ass agenda is pretty disgusting even for you.

Funny how you can ignore all this when the police are putting their hands on a little Gal because she wont give evidence against herself. You heard them conclude with their own mouths "no crime", but there you were 3 months later trying to provide RAS for them.

Hey, guess what. Kiwi’s mom isn’t going to fuck your nasty, old ass, so chaining what’s left of your body to the police front door isn’t impressing anyone. But boy, do you love to rehash old shit over and over. I love how steadfast you are about the cops’ own words when normally you give zero credibility to anything else they have to say. I don’t think it matters. Her behavior was disturbing enough to warrant a discussion for public/her own safety. Her erratic behavior with a butcher knife shouldn’t get a second look? Not disturbing at all to trespass in a yard while carrying a butcher knife. I am sure she was perfectly fine to drive our streets either blasted on drugs or mid-mental crisis. Nothing to worry about there. “Sorry maam, you go on about your day.”

There’s nothing that needs justifying in locke’s case. No knock warrant for a murder suspect? When should no knocks be used if not for a murder suspect? And during the execution of that warrant, a man points his gun at cops and gets shot. Tragic, but justified shoot. But but but the AG and mayor put an end to them after this issue. Because they are in MN, a cess pool that only cares about a black life if it is taken by police. I wonder how many protesting knows the name Otis Elder? Very few, if any. Locke’s life is worth more than elder’s because it was taken by police and it means more than the cop he pointed a gun at.

They don’t know who he is. He’s asleep on a couch in a murder suspect’s apartment and sits up and points a gun at a cop. “Stop guys, don’t shoot-he’s startled, tis all. give him a moment to right himself whilst he points his gun at you.”

It’s a justifiable use of force. Lawful but awful as donut operator would say.

Hey, guess what. Kiwi’s mom isn’t going to fuck your nasty, old ass,
You Sicko, what perverse thought process took you there? Projecting? She signed up here because there was an ongoing discussion about her daughter. I was the one pushing hard for a discussion on the OIS incident involving KyrieAnna Liles #FreeKiwi. If someone had a more favorable opinion of my child than the one being pushed by the mainstream, I'd hear them out also.

so chaining what’s left of your body to the police front door isn’t impressing anyone.
How about the fact that I called her case out as BS by a corrupt PD trying to cover for it's own incompetent law breaking thugs a month before a Civil Suit was filed on her behalf. Have you looked at the docket? Now, over 3 months aftter araignment, a motion to dismiss has finally been filed. I was calling for that motion nearly 2 months ago.

I love how steadfast you are about the cops’ own words when normally you give zero credibility to anything else they have to say. I don’t think it matters.
You don't think the Officers own words and conclusions about their on scene investigation matter? Okay Bird Brain.

Her behavior was disturbing enough to warrant a discussion for public/her own safety. Her erratic behavior with a butcher knife shouldn’t get a second look?
A consensual investigation. Anything more than that requires RAS.

Not disturbing at all to trespass in a yard while carrying a butcher knife.
THE OFFICERS THAT INVESTIGATED THIS COMPLAINT REACHED THE CONCLUSION THAT NO CRIME HAD OCCURRED. They say that with their own mouths. But the 20/20 hindsight of a Bird Brain is more important than the conclusions and words of the Officer in regards to his level of suspicion that criminal activity was presently afoot.

I am sure she was perfectly fine to drive our streets either blasted on drugs or mid-mental crisis. Nothing to worry about there
Even while fleeing being abducted and shot at 10 times, she was charged with a grand total of ZERO driving infractions.

But since you bring up driving..... It was actually Officer Booth that crashed out the lead vehicle in the pursuit pack while performing an obviously unsafe U-turn. He must be on drugs huh?

There’s nothing that needs justifying in locke’s case.
Just the warrant procedures.

No knock warrant for a murder suspect? When should no knocks be used if not for a murder suspect?

As previously noted, that is a different conversation.

Tragic, but justified shoot. But but but the AG and mayor put an end to them after this issue. Because they are in MN, a cess pool that only cares about a black life if it is taken by police.

The AG and Mayor took those steps because a man lost his life. That man was a law abiding citizen at the time of his death at the hands of the police.

They don’t know who he is. He’s asleep on a couch in a murder suspect’s apartment and sits up and points a gun at a cop. “Stop guys, don’t shoot-he’s startled, tis all. give him a moment to right himself whilst he points his gun at you.”
That's a good argument for banning no knocks.

It’s a justifiable use of force. Lawful but awful as donut operator would say.
It's like you are wallowing in victory because another young person of color lost his life to the hands of the police without anyone facing repurcussion.

Justifying the shooting and justifying the young man losing his life are 2 different things. You're too damn stupid and full of hateful agenda to realize that.

You don't think the Officers own words and conclusions about their on scene investigation matter? Okay Bird Brain.

A consensual investigation. Anything more than that requires RAS.

I am not enjoying or revealing in anything. And the only mention of race that I had is that a. There would be zero protests if he had been white and absolutely no one protests-same as how they don’t”say his name” for Otis Elder’s murder because it wasn’t a cop. Otis life meant nothing based upon no marches for his death. This has been a heavily covered topic that has people on both sides of the fence. Locke had a legal right to carry when he does the Uber job. Understandable, but sleeping with the gun at his cousin’s house says a little more to me about what kind of person he was. Bringing his gun there, why exactly? Hanging with thugs that just so happened to have recently murdered someone shows either complete ignorance or willful disregarding red flags about his cousin and their behaviors. Might be time to stay elsewhere, like his own residence.

And innocent of the crime or not, he pointed his gun at an officer and he was shot for it. Maybe he was disoriented but the constant shouts of “police department search warrant over and over probably should have tipped him off that the police were there and maybe don’t point it at them?

Then he has the right to sleep with a gun under his pillow or on the coffee table or w/e.

Understandable, but sleeping with the gun at his cousin’s house says a little more to me about what kind of person he was.
Your attacking the character of the deceased, who was a law abiding citizen. Are you doing that because he was black?

Bringing his gun there, why exactly?
Because he was a licensed gun owner. Would you prefer he leave the firearm unattended in his Uber vehicle?

So you are assuming he had knowledge of all his Cousins actions simply because he was sleeping on the couch? And wasn't it reported that he was days away from moving to a different state? Happened so long ago the details are fading.

Your lack of reverance for Locke's life is pretty gross. Your'e a sick puppy, hope you get to a vet soon,

It’s kind of funny watching you squirm in circles trying to make me out to be heartless bad guy while you tried almost every tactic-weak name calling, lobbing accusations with zero basis and race baiting with “you’re just doing this because he was black.” Fucking pathetic.

My lack of reverence has nothing to do with race. I want to see a similar response to the death of the og victim, Otis. He got zero exposure because his shooter wasn’t a cop. That famous phrase “black lives matter” has a huge footnote that states “but only when it’s the cops or white people-then you shall not utter the names claimed by the streets. Ignore that completely but get really angry when a cop shoots someone.
