I think the better question is Why should they have to. As long as they aren't fighting under the influence and as long as its legal in the state, why should it be an issue.
Diaz has another hurdle though. In CA, the medical marijuana laws only keep you from being criminally prosecuted. They don't over rule the state employment laws that allow an employer to fire you for failing a test.
So fighters like Diaz are in this gray area where I think they should be granted a TUE, but if they don't give it to them, the state really isn't wrong.
There is another gray area that needs to be discussed. Should it be based off of the home state of the fighter, or should it be based off of the state they are fighting in. I would think that you would look at it by what state the event is taking place in since that is the state where they are being employed, but that would be better answered by somebody who understands employment law.

Long, slippery slope ahead with TUEs for marijuana, however, its long over due to get this ball rolling and see where it ends up.
 
Nick created an unwinnable situation for himself when he lied on his application. He told them that he hadn't used it in 15days and then admitted later that he used it 7 days before the fight. Falsely filling out your paperwork is grounds for and warrants a suspension in itself. Chael had a prescription for TRT but wasn't reporting it, and the lies got him over a years suspension, so why should Nick be any different?
I work with a few athletic commission guys in the SE, and most of them are nice guys who are pretty lenient IF you are open and honest. They care more about you being truthful than what you did. They rely on the honesty of the information in the paperwork to determine if you can safely compete or not and your safety is their primary concern.
If we are going to get this ball rolling, guys are going to have to be honest and do things the right way, and that we have yet to see.
 
When you have high level social anxiety and you are heading into the biggest fight of your life with the most media and fan eye balls on you...MASSIVELY HARD.

People with high level social anxiety often cannot even get out of bed if they know they have to present in front of 10 people at work that day.

I am no marijuana booster but it is so sad that guys can drug up on all sorts of harmful pharm drugs to control stuff like that but smoking a natural product that is way less harmful is prohibited because big pharma cannot figure out a way to control and sell the functional ingredients.

Will power. You either have it... or you don't. That's all it boils down to, really.

Sure, any of the Prozac derivative drugs can control social anxiety. but they also have horrible side effects and can have horrible withdrawal issues when you try to come down off of them.

Not sure if the commissions would allow those drugs but I doubt a fighter could be effective with them.

No it isn't. It's under the department of Business and Industry. The lawsuit got thrown out because it's without merit.
 
at this point i dont understand why diaz is still fighting his suspension. he knows upon returning from his suspension he has a title shot waiting for him. this whole court NSA , Kozer shit confuses me

depends on the state. I'm not really familiar with the setup in Vegas. In states like SC, the licensing and regulation all fall under the same department as the state police. I'm pretty sure GA is the same way, as well as many other states.

I have never struggled with mental disorder issues and am glad for that.

maybe we can all pretend it is simply will power or weak minds that suffer them but science suggests otherwise. in the billions of people on this planet I can see a few with a brain chemistry disorder that could make them wired different.

My friends mom has suffered agoraphobia since she was a child. When it peaks she cannot leave her house. Maybe it is a simple will power thing. I don't know. Science suggests otherwise.
