Don't know if their is a thread on it but Matt and the train company have both put out their statements and allegations.
Matt's Side.
Hughes alleges that the Norfolk Southern Railway ("NS") was negligent by not warning motorists of dangerous conditions at the railway crossing. The facts relate that the train struck the passenger side of Hughes' Chevy Z71 truck at a rail crossing close to his residence in Montgomery County, Illinois. Hughes was knocked out and did not readily revive. But there are no allegations of broken bones or other internal injuries, other than the TBI and related disorders.
According to the lawsuit's allegations, NS did not place appropriate warning signs at the site. Even worse, Hughes alleges that NS knew of the potential danger beforehand and did not act. Furthermore, Hughes stated that he was driving lawfully before the crash. The collision resulted in severe physical damage and a traumatic brain injury.
Norfolk's Side.
The railway believes it is not at fault. NS stated that the crash was Hughes' fault. The company stated that Hughes failed to stop before the crossing. Furthermore, NS states that Hughes did not see the train oncoming and failed to yield the right way. The company goes so far in their rebuttal to state that Hughes "knowingly drove his vehicle onto a railroad grade crossing" and used his cell phone.
No offense, but as a former attorney in Chicago, now a barrister and solicitor in Vancouver, there are many problems with your post, and the replies. I don't know where to start but I'll try to point out just a few:
1. The source. A website for a law firm in California has written a very poor description of the complaint and response, which they took from mmafighting.com!
2. The website for the law firm in California compares Matt Hughes to Alexander the Great and George Patton.
3. The MMAfighting.com article is from September of 2019.
4. The case is still pending. Quite a lot of information is available free on Montgomery County's Circuit Court's website. However, access to the complaint and response requires a subscription to Judici, which is quite expensive. Since these are public documents and I'm sure every court in Illinois has gone to electronic filing, I will see if I can track them down elsewhere, I always practiced in Cook County so I'm not familiar with this little county's protocol.
5. This post is almost two years behind the times. The complaint was filed on June 7, 2019. The response was filed July 11, 2019. It is currently May 21, 2021, in Hillsboro, Illinois (where the court is located).

7. This law firm is not impressive to me. The owner, Mr. Ehline, attended the University of West Los Angeles, which is not an ABA approved law school. He can only practice is California. He describes himself as "Great Leader" and "Elite Among Men and Law Practitioners".
