I don't really get the whole premeditated thing in this case. I think about a crime of passion like a person is overcome with rage at seeing their spouse cheating and kills one of them. That makes sense as a non premeditated crime and is different than a criminal choosing to murder someone because they just feel like doing it.
But in this case you have two guys choosing to murder a random guy on the street. I don't get how that is less serious than if they discussed murdering people let's say before they stole the car. Why would that be more serious?
The hate crime stuff is fucking stupid. Hate is basically always part of these crimes in one form or another. It's not a worse crime because they specifically hate one particular thing like that person's race.
Intent, i.e. does it appear they were deliberately trying to end a life, or did they just want to hit a pedestrian on bike, without regard to consequence? I would argue the video sugges
The degree of "premeditation". Is making a split-second decision to mess somebody up for fun, the same as sitting at home and plotting to murder somebody, in regards to how it should be judged?
I agree that "hate" generally shouldn't matter in a crime, except insofar as it might support the act was premeditated. Being a bigot is not the illegal act, but murdering somebody is.
