Former UFC Champion Cain Velasquez sentencing this Monday

I was thinking about that second part this morning. In one of the past threads I made a comment that I hope he's not guilty and everyone acted like I was cheering him on. Nah, I want the outcome of this to be that a child wasn't abused. So many people are hoping he's guilty, completely ignoring that means they're hoping the he abused a 4 year old. They're fucking dumb, and sick. As for any new evidence, I feel like had there been any new evidence it likely would have lead to additional charges that we would have found out about by now. They won't move into the trial and then say "oh by the way, here are more charges." but I do agree with you that we haven't seen all of the evidence, and there is plenty of information that will come out during the trial that we know nothing about. As for the people who "are in the know" - I'll never believe them when they post here.
How do you hope something didn't happen 2 years ago ? So stupid

Cain will be out in under 2 years with a presidential pardon, after Dana tells trump why Cain was sent to prison..

I would imagine he spent a lot of his money on lawyers. I hope when he's out the UFC will give him a few big fights to recoup his money if he wants that
Seems like he was really taking to rasslin', even got permission to cross state lines while awaiting trial. Maybe WWE or AEW will throw him a bone.

I think he tried the WWE didn't he? I don't think he made it. To be honest his personality is almost two passive. But either way hopefully he can make some big bucks. I actually think he would give John Jones a run for his money even at 43 if he only serves a year

He wasnt made for WWE but he was doing real well with his limited appearances in AAA Lucha Libre(Mexican rasslin), he could definitely go back there for a few pay days if he's able to get action on his post-release travel restrictions, I think he could do a few shots for some Japanese wrestling companies also, doing some "worked shoot" style matches over there once in awhile

Strong style Cain

WWE had Vince with his usual hard-on for slow big guys. So instead of being able to do some cool lucha shit with really work rate guys who could carry a match, they did some dumb workshoot match with him and Brock and it was awful

Despite your constant attempts to obfuscate the term, it is what he was charged with. So it's funny for to say "armchair district attorneys" about the people who charged him with it.

Considering some of the reports suggesting that his actions were not anywhere near his time of learning the crime, and that he got into his vehicle with a loaded firearm, and followed the parents to where they picked up the guy before ramming them and opening fire, that would suggest the charge was called for.

I’m not trying to obfuscate the term, I’m doing the opposite which is clarifying the fact that it is a flexible concept and its application can vary depending on the jurisdiction and specific case circumstances.

And I’m delineating the factors that come into play in order to establish it: intent, planning, mental state, time for deliberation, manner of the killing.

There wasn’t direct evidence to prove he had intent to kill before the chase, only circumstantial.
No confession, texts, writings, or witnesses to explicit plans to kill, no weapons purchased for that intent, no extra ammunition or other weapons than the already owned gun, no costumes or planned ambush. The extreme emotional distress and reckless chase shows a disturbed state of mind that acted impulsively.

DA agreed to lesser charges rather than risking an acquittal on 1st degree murder attempt.

And just so you know “attempted premeditated murder” is not a charge in California, that would be 2nd degree murder.

1st degree murder requires:
Intent
Premeditation
Deliberation

Attempted Murder: Deliberation and Premeditation (Pen. Code, §§ 21a, 189, 664(a))

Judicial Council of California Criminal Jury Instructions (2024 edition)

If you find the defendant guilty of attempted murder [under Count_______], you must then decide whether the People have proved the additional allegation that the attempted murder was done willfully, and with deliberation and premeditation.

(The defendant acted willfully if (he/she) intended to kill when (he/she) acted. (The defendant deliberated if (he/she) carefully weighed the considerations for and against (his/her) choice and, knowing the consequences, decided to kill. (The defendant/_______ acted with premeditation if (he/she) decided to kill before completing the acts] of attempted murder.

The attempted murder was done willfully and with deliberation and premeditation if either the defendant or _______ or both of them acted with that state of mind.]

The length of time the person spends considering whether to kill does not alone determine whether the attempted killing is deliberate and premeditated. The amount of time required for deliberation and premeditation may vary from person to person and according to the circumstances. A decision to kill made rashly, impulsively, or without careful consideration of the choice and its consequences is not deliberate and premeditated. On the other hand, a cold, calculated decision to kill can be reached quickly. The test is the extent of the reflection, not the length of time.

The People have the burden of proving this allegation beyond a reasonable doubt. If the People have not met this burden, you must find this allegation has not been proved.

As some have mentioned, the president can only pardon federal crimes which are under their jurisdiction. States have their own laws and courts
I’ll believe it when I see it,

With this administration…

By hoping it didn't happen. How is that hard to understand?
"I hope the boy lied and just made up all these things that got his father in jail and that man injured in his arm" "I hope the boy is mentally ill and at 4 years age makes up stories about getting assaulted"

I think it was too lenient if anything but Cain did plead no contest instead of going to trial and I don't have anything against him personally so I'm not going to lose sleep over it.

If he goes after the guy again though he's gotta get thrown back in for a long time.
It was probably was too lenient given that he could easily have killed or seriously hurt people that had no role in what happened.

Meanwhile he's pulling off a hurricanrana on the indie scene.
