How many companies do you reckon get punished when it's clearly going on? I worked for an Indian company for years and years, I was part of the furniture and like family. The CEO wouldn't hire a black person apart from one guy who was best friends with his nephew growing up. And it was literally because he was racist against black people. I was underpaid against a co-worker as a female with him doing a terrible job and me going over and above my sales target so I went to Mr CEO and told him I needed an increase on my salary. IT was VERY male orientated, I was the only woman in sales. Should the CEO be taken to court for paying me less than a useless male colleague?
I don't know but shouldn't you be pushing to have companies punished for being racist? Curing discrimination by using discrimination means you're no better than the racist CEO who won't hire black people. He has his justifications for why he doesn't want to hire black people and the pro DEI people have their justifications for why they don't want to hire white people. They're both equally racist.
I've been paid less than useless colleagues as well. I can't tell you if the guy was discriminating against you because you are a woman or if the other guy just got hired on at a higher salary while you accepted a lower salary during the hiring process. Either way the fix is not to force the CEO to start discriminating against men to cure his discrimination against women. The point is to get rid of discrimination. Not use it as a force for when you deem your certain discriminatory process it to be the right thing to do.
