The problem here is no different to anywhere else, unless you've been through it (and I have) you don't understand it.

Words used by the court to describe their processes are bastardised. They're not used in a way that a normal average person would use them. I'd argue they're bastardised to give legitimacy to civil courts, because if the public knew the truth, there would be outrage.

What do I mean by this? So, in English civil cases (Ireland will be similar), prior to the court hearing there is a finding of fact. This consists of evidence being presented by both sides. These facts are the presented to the judges or jury. Think about what YOU think this means before reading the next part.

So, 'evidence' provided for a 'finding of fact' is often a statement or an argument made by an accuser. A story, a set of events and a list of allegations. 'Facts' are established, based on this 'evidence'.

One side tells a story, and as already mentioned here, you decide which side you believe is MORE likely to be telling the truth, even if you're 51% sure.

I'd argue that overwhelmingly, in most peoples minds, 'evidence' is concrete. Something definite, something presentable to court. And a 'fact' or 'finding of fact' is something truthful based on evidence. This is not how civil courts operate.

'Proof beyond a reasonable doubt'. Proof. 'conclusive/definitive'. Civil Court is 'proof' based on 'facts' based on 'evidence' that is just one persons words.

There is a court of law that deals with facts and truth and that is where this should go. Just because you believe the story does not mean everyone will. It is a sad story but it should have gone to criminal court if it was that damning.
