Criminal charges require a higher standard of certainty to conviction requiring proof beyond reasonable doubt. Which they didn't believe they had. Lot of rape cases don't get convicted as it ends up down to He said she said only, which is difficult to prove to that certainty. Civil cases just require a likelihood of liability, and not concrete beyond reasonable doubt to get a verdict.
