To clear up criminal vs. civil. Criminal cases are levied by the government and have the burden of proving guilt beyond a reasonable doubt. In civil cases, a private party sues another party. They do not have to prove guilt, merely the offending party more likely than not committed the offense which is a far lower bar. Guilt is not determined, only liability.
