Crime Chicago and other cities suing Kia and Hyundai for rampant car thefts.

I'm trying to remember if anyone had a problem with the states that sued Big Pharma for the opioid epidemic.
not the people I know who's families were stupid enough (ya, that's right, I wouldn't trust a doc as far as I could throw them) to take the drugs. I have almost zero sympathy for these dummies, especially people who are Native American. You really are dumb if you trust anything you're told, don't blame the man.
 
In a ridiculous, but unsurprising move, Chicago mayor, Brandon Johnson, has filed a lawsuit against the auto makers for failure to install anti-theft chips.
Johnson claims that Kia and Hyundai are responsible for the extreme uptick in car thefts of these brands that are being used in other crimes such as thefts, robberies, and murders.

Brought to you by the same people that sue gun manufacturers for people using weapons to commit crimes. They blame these companies instead of the criminals and the criminal culture that leads to these types of situations.

Legally, the city has an argument. It's no different than any defective product when the manufacturer is aware of the defect and doesn't do something to fix it. The manufacturer becomes liable for the foreseeable ramifications of that defect.

Here, if an individual was suing because the problem led to their car being stolen, we'd all immediately see the legal argument. The manufacturer does too, that's why they issued what recalls they did and anti-theft responses. But the cities are also being affected and there's a cost to them as well.

I don't know what evidence they'll need to prove their point but I don't think it's as uphill as others might think. They can show when the problem began, differences in car theft attempts before and after the problem became known, difference in theft success before and after, number of calls made to police stations based on these thefts, what percentage the call volume increased, the impact on police resources, etc.

If they can cleanly tie the data together, it's a winnable case. Other cities have sued companies over products that lead to dangers to their citizens and been successful.

Because that's how product liability works. If I make a product and fail to include a standard safety feature that results in an otherwise preventable harm, I'm liable.

Car theft is a foreseeable result of bad safety features. If I know that a certain type of standard safety feature is being used to prevent a harm that I know is out there then I'm supposed to use it.

This is why we have safety labels on things. Once a safety hazard becomes commonly known, the manufacturer needs to account for it in their design. Why do you think so many toys say "choking hazard"? Because we know that kids stick things in their mouth and they might choke on it. We don't say "That's too bad, the parents should have paid better attention and prevented the incident." Manufacturers address the problem with a label.

Kia and Hyundai knew of the problem and let it go to market anyway. They used to use immobilizers up to 2010. Then they removed that feature thus making their vehicles less secure than before. That's their problem and why they already settled a class action on this same issue with consumers. And, again, no one bitched when consumers litigated this and won.

it's like the really old way of stealing a car you override the ignition and use a tool to turn the igniter..... not exactly easy to do, but not too difficult for a motivated thief. You still have to break in the car and break some panels, so it's not like it's open season.

it's not a defect, it's just that other cars are tougher to steal with deeper ignitors that take more work to get to

But there is a bad issue of good police officers not wanting to rat out the bad ones. If they did, we wouldn't be in this mess now.

For the life of me, I don't understand why anyone would buy a Kia or Hyundai. People are paying like 50k+ for Tellurides.

Historically there’s always been a top 10 vehicles that are stolen, for multiple different reasons, and historically those vehicles are expensive to insure. These vehicles are damn right uninsurable. Do not buy a 2011 to 2022 Kia or Hyundai..
