Prosecution now needs to charge the brothers with assault and battery then right?

No they don’t. If there is no one to sign a complaint there is no crime.
 
You haven't been paying attention to the media and social media if you thing the right is angrier about this than the left is about the Mueller report.

Two different scenarios as well considering the prosecutors said they believed Smollett was guilty and had the evidence vs. the Mueller report saying there was no/insuffient evidence. If the Mueller report said there was evidence but they just let Trump go that would be comparable.

Fawlty is a partisan shill and should be ignored.
 
Fabricating a heinous hate crime for national attention and regurgitating multiple lies to the authorities should be strongly punished by any government worth anything.

Regardless of what race and gender boxes they check off on their public persona resume.

This is an outrage, an outright charlatan manufacturing bigotry for bucks and the fawning sympathy of other faux starlets, and then a spineless and likely corrupt prosecutor sticking it to law enforcement and civil government, all while sealing up the charges.

Diversion programs aren't too uncommon, usually for first time offenders with relatively minor charges. It is absolutely not common for cases like this. Moreover, diversion programs take time to complete and are monitored through probation. They just dropped the charges. No program, no probation involved.

Furthermore, diversion programs frequently involve characteristics such as
(1) consent of the victim
(2) making the victim whole
(3) taking responsibility of your actions and admitting guilt

Smollett has none of those features. As a matter of fact, the first thing he did when his charges were dropped was to claim innocence, talk shit to the police, and throw his friends he hired to attack him under the bus.

Yep. You basically make an admission that the prosecution had enough evidence to convict in court. This was not diversion.
 
So if, for example, The POTUS were to get involved...even he couldn't do anything?

They could investigate the court that dropped his charges, charge them and then go after Jussie even harder
