It’s tough to tell from the video what the driver’s intent was. I’m torn between her not seeing him, or seeing him and trying to drive around him, as it looks clear to me that she wasn’t driving directly at him.

Lot of people will be spinning narratives. Right might say shes trying to kill him, left will say she was executed. It seems a bad combo of bad enforcement tactics with person trying to flee(bad citizen tactics).

She wasn't trying to hit him but ultimate subjective intent of the driver is not going to be an issue. There was a real risk striking the agent while fleeing and it will come down to what a reasonable officer in this situation would have felt in fear of injury/death in that split second of reaction of a vehicle going into drive that fast at such a close distance.

The issue is that she hits the gas while the vehicle is pointing at the agent....infact the tire is pointing to slightly left of the officer when she hits the gas. He initially goes for his gun at that very moment when the vehicle is in fact pointed at him(even the tires) and her tires are spinning because there is ice on the road(ironically). That office is also standing on ice meaning he has little grip as well and he's probably around 2 feet from the hood. His defense is simply going to be she launched the vehicle at him at an incredibly close distance and he reacted with deadly force because he believed that he was in danger. There will most likely be more video on this that will either further his defense or do the opposite and hurt his case but her launching the vehicle that aggressively and close while pointed at him initially is going to be the bulk his objective reasonable test defense. It would seem crazy to me anyone who thinks this is a slam dunk guilty case unless you have an agenda. I don't know if its slam dunk that he wont get prosecuted either at the state level but there is a defense here but we will find out if they attempt to prosecute at the state level(i doubt at federal level)

Another misunderstanding is that people think ICE agents don't have the authority to detain her as if being in a vehicle grants magical powers like she has an hidden immunity idol on Survivor. They are federal agents and if they deem that you are obstructing justice they can in fact enforce it and they will obviously claim she was. There is no magical "they have to go around you" rule. Thats made up shit that gets people in bad situations. The difference is they typically don't enforce it as its usually not productive to what they are doing. There is a good post on Reddit I just saw that explains the bulk of the confusion.
