Not really. If you are in fear of getting hit by a car you take evasive action. A bullet will not instantly stop a car at that range. His intent was clearly to stop her escaping rather than fear for his life. The fact he kept shooting when she was well past him proves this intent. He wanted to stop an escape.

I dont think anyone has said she hit him on purpose; only that it was his perception that she did. And that his perception is the overriding factor for justifying the shooting. At least the initial shot.
