But if he has some ongoing PTSD from a prior instance months ago where he's afraid of every vehicle and that's why he killed somone, he shouldn't have been back on duty. This lady can't be expected to know what the triggering past of every masked man who pulls a gun on her is and to avoid scaring them.

I agree that he may not have been right for duty. But I disagree that her actions didn't 100% contribute to her fate. We don't know if a different LEO in his position would have done the same thing.

It all sucks. So now we get riots and more people hurt.

Yes Trump, Vance, and Noem are all saying the ICE officer(s) will be immune to prosecution under Neagle.

However, the math has changed in 2025, and they are probably not aware of it. The SCOTUS decision Barnes v. Felix (2025) completely changes the math. You can no longer use "moment of threat" justification for immunity. Federal Judges are now legally required to consider the totality of the stop under Barnes.

Did the officers have legal jurisdiction for the stop? Was there a 4th amendment violation? Did they use effective de-escalation techniques? Did they "back down" and make all efforts to keep themselves out of harms way if the suspect panics and flees? Once the suspect pulled away, did they make every effort to "back down and escape" before shooting?

All of this applies now when determining Federal agent immunity, and this might be the very first test case where the Barnes hammer meets with the Neagle wall.

Yeah I would lean more towards she didn't even see him than I would that she intentionally tried to run him over.

Does it matter if she saw him?

I mean, it shows she wasn't intentionally trying to hit him, but wouldn't change he biew of the situation.
 
No denying that. Dumb moves on both sides. I don’t think they are solely responsible for creating the consequences however.
There are some more questions I'm waiting on like how long was she actually there. What were her interactions like before hand. I just haven't currently seen anything to back up that she was trying to block ICE from doing anything yet.

It's in the question and answer part of the conference. You should really try reading and watching the entirety of the things you post. You do this all the time, you just read the part you like and skip the rest.

She says they completed their active operation and were headed back to their headquarters when one of the vehicles got stuck.

The Q and A starts around 6:30. At 12:34, she says:

"We had law enforcement officers doing an enforcement action and a vehicle got stuck in the snow and so they had called for other people to come and help them get that vehicle... when the harassment started... when the protesters were out there impeding the vehicles and preventing them from leaving the scene..."

"They were returning back to headquarters, I believe to start another operation, had just completed one."


So if they're going to start another operation, they're still operating for the day.

Why the hell does that allow people to actively impede them?
 
Hopefully she "Leared" her lesson. At least there are plenty of vacant day cares in Minnesota to watch after her orphan. Kudos to the Agent who was quick on his feet and neutralized the domestic terrorist threat so no one was hurt.

Come on dude. The lady died.

Sounds like a copout by the state to be honest.

What they are saying is not true. They can collect witness statements. There is independent video. They can put out an arrest warrant for the ICE officer(s) involved. The only exception would be if they are not even able to identify which ICE agents were involved in the shooting. Then they have a problem.

This just sounds to me like the state trying to take the heat off them, because there is massive pressure by the public for the state to file charges.
 
While I want a full investigation to be done before I pass any judgement (at this juncture, I think it is a tragic event, but I am not willing to say that the agent maliciously executed her), I think Christy Noem calling this woman a domestic terrorist is preposterous. We are quickly sliding down a slippery slope where protestors are met with violent force because they were deemed "domestic terrorists".

If there is one thing this administration has shown, they will find any excuse to rationalize their abhorrent behavior.
If he didn't have malicious intent, why did he circle the vehicle counter clockwise when he already had a good vantage point on its right where he was in no danger whatsoever? Why did he take the time to draw his gun (contrary to policy) rather than simply step aside when he had ample time to do so, and how was he ever in danger when he shot her and still had time to move out of the way (in as much as severe injury was not a possibility?

I'm fine with passing judgement on this fascist prick.

ICE agent has ‘absolute immunity’: JD Vance​

"Vance also defended the decision to sideline Minnesota state authorities from the investigation, saying that the ICE agent involved has “absolute immunity” as a federal officer. He argued it would be unprecedented for local officials to prosecute a federal agent acting in the line of duty. Much of Vance’s frustration centered on press coverage. He accused journalists of portraying the ICE agent as a “federal assassin” and described the reporting as one of the most egregious media failures he had ever seen."



"Vice President JD Vance wrongly claimed Thursday that the ICE agent who shot and killed Minneapolis poet and mother Renee Good is protected by “absolute immunity.”

Vance’s assertion came during Thursday’s White House press conference when a reporter asked about the FBI cutting Minnesota officials out of the investigation.

“The head of Minnesota’s investigation agencies says the U.S. Attorney’s Office has essentially cut off the state investigation agencies’ access to the investigation,” the reporter said. “What is the precedent for that, and why shouldn’t the Minnesota officials on the ground have access to evidence to work on this investigation?”

Vance answered, “The precedent is very simple: You have a federal law enforcement official engaging in federal law enforcement action — that’s a federal issue. He is protected by absolute immunity. He was doing his job.”

 
I will never understand how people put more fault/responsibility on the common untrained person then the people who are supposed to be trained to deal with high stress dangerous situations.
