I graduated high school in the eighties and three years was a pretty huge deal.

One grade difference was pretty common, two less so, and three was almost unheard of.

I said its rare but I have seen a you girl lie to a friend when I was young. Her older friends backed her up. She was coming on to a friend of mine that was 18. She looked order. I told him to back away because her friends didn't seem quite right and something felt off. This was at a private party her friends brought her to and there was drinking. Guy is 19 and in the navy. Very socially awkward. Probably closer to 15-16 maturity wise. Girl is 13. Says she’s 18. They sleep together because obviously if any girl said yes to this guy he’s going in. All of this I can see up to this point. I’d settle for someone just kicking him in the ass hard and telling him to stay away.

He then proceeded to date her because he’d essentially already done it at that point. Only a matter of time from there and he goes to jail for a couple years and gets registered. This all seems appropriate with an argument maybe to be made of taking him off the registry in 10 years or something. I don’t have my feet planted. This would also be a wild exception and not the rule.

The story seems to say 18 and 13. That’s not great but hardly 40 and 13. I’d probably settle for the least aggressive possible felony charge depending on exact circumstances. I could go a little lighter in the above scenario

I think that's a good rule. There would be a lot of times it's not used in 3 year gaps because parents (rightly or wrongly) don't see a problem and so on, but the law is there for when it's needed.

Sounds like a great plan and I think most are either 2 or 3 year gaps. The idea should be that we aren't sending an 18 yr old kid to jail for dating his hs girlfriend because she's a year younger.

I had a 12 yr old friend that could pass for 16; appearance wise. I used to have to threaten 1 of my friends in hs all the time to leave her alone. Not saying it makes it ok, but I could see how a hs kid would be like 'yeah she's fair' if he didnt know.

Ther is a link that said he was a hs senior. You become a freshman at 13; hence my comment.

I would need more information on the case to make a judgment on what the guy should get. The law sounds OK in some very rare cases.

You need more information on this particular case to say what he should have got.

First did you know the girl was 13 if so then he should get the rape charge.

If she she told him she was 17 or 18 or something and looked it then I can see a reduce charge if that can be proven. Still a very serious charge, a felony but its rare this can be proven.

It hard to know without more information.

No dumass you must prove it was resemble that the person would not know they were under age. Its not easy to prove. Its rare it requires a lot.
