Call it what you want, but I see equal amounts of flaws on both sides of the isle. In practice I'd say I'm a moderate conservative, but politically it's really hard for me to pick a side because of all the shitty people/policies involved at every level. Personally I think the '2 party' system (yeah, I know there are a few other fringe parties) has run its course. I don't pretend to have all the answers, I just feel like when I see/hear one person harping on and on about 1 party in a specific light, I don't see them do the same when the shoe is on the other foot.


States rights, in this instance. But there are other things too.


I guess at the end of it I would like to see consistency out of people. Too often I see people use something as a sheild on one subject, and then as a weapon on the next.

And nah, it's not a win-win. Weren't not in a situation where we need to over tax anything to that degree. Cali already has a high cost of living. Business including dispensaries are already paying a fair amount of taxes and so are consumers. Over taxing something that's bought as prevalently as bud light in South is going to be financial strain on a lot of lower and middle class budgets, not a saving grace. A decent percentage would just buy black market, which would be flourish with little to no fear of persecution, and the state will never see the money.

Go ahead and tax it well but exorbitantly? Not necessary.

Sure it is -- people will pay extremely high tax for weed and other vices, it's a staple product and your tax code HAS a clause in it to allow a ridiculously high federal tax on it. People are going to buy it no matter what (you're right it may create a black market for it -- but take into account the black market for cigs in places like cali and NY, you are fine with high taxes on that product and the results). People get still get their weed, feds get a massive influx of revenue. Win - win.

Who cares if poor or lower middle class has to pay more of their income for weed -- they pay extremely little in fed incomes taxes -- this is their way to pay more of their share

Good, hopefully this forces the do nothing law makers from those states to introduce a bill in congress and fight for it the right way. The only thing that makes sense is to ACTUALLY legalize it on the big stage. The support should be there

For a majority of smokers in Cali, they have medical rec card. It's as easy to get as a library card. Does this clause allow the state to ridiculously tax patients for what the state consider's medicine? Honestly curious because that clause doesn't seem to be address substances that are medicinal.

they actually did this in SD county when dispensaries first opened. Went from like 10 in the SDSU/college area to like 2 in a heartbeat b/c the of the uncertainty w/ complying w/ Federal Narcotics laws or whatnot

Hope it doesn't happen, this isn't like sanctuary cities where people actually agree w/ the right on. Literally nobody agrees w/ them on this

Plus there's way around it. For example, dispensaries in my county are illegal (storefronts), but delivery is allowed if it's voted on by the city. My city voted against it, however, do you actually think there are no working dispensaries in the area?

As to the guy who just asked, as of now, if you retain your card in Cali you won't have to pay any taxes added from the recreational sales.

The federal government doesn't exactly like to give up power once they have seized it. The instances of this occurring in our history are very limited.

You're speaking my language. Commerce clause needs redefined and we need a convention of the states to create the Amendment to do it. lol at Congress taking power out of their own hands. That's why it was a mistake to make Senate seats a matter of popular vote. Sucks the power up and into the federal offices.

It would prevent new dipenseries that can't get medical licenses to sell. The exorbitant tax only applies to retailers. Buyers are only currently subjected to 10percent sales tax
 
I just don't see it happening in legal states. You're not going to be able to enforce anything without a serious backlash from the states that have legalized it. Plus rounding up all the budtenders would be almost impossible.

Indeed. I feel like all the states should vote on this. And if there's a large enough push, get it legalized at the Fed level then let the states regulate it as they (their voters) see fit. Some states people may not want it. But let the people speak on this issue. Government needs to stop trying to tell the people they will do what they see fit and know what's best for everyone.

I've always liked the weed issue as a jumping off point for getting people to think more seriously about state vs. federal authority.

Anyone who believes in "law and order" as the POTUS said he did has no moral obligation but to support the federal government in enforcing federal law. It's especially true for anyone who had a problem with Barry O. using executive orders to impact prosecutorial focus during his term. It's triply true for anyone who argues that the fed should crack down on sanctuary cities because those cities are acting in a way that contravenes federal immigration law.

People have to take foundational positions on this subject. Do you want the fed to brightline enforce federal policy and bring the states to heel? Or do you want the fed to relax its enforcement of these things and let the states chart their own course?

But the weird space where the fed strongly restricts state action sometimes and not others can't continue.
