Trump Lawyer Drops Attack on E. Jean Carroll Counsel’s Ties to Judge​

"Donald Trump’s lawyer backtracked from her suggestion that a new trial may be warranted in writer E. Jean Carroll’s defamation suit against the former president because the presiding judge in the case worked at the same law firm as the New York writer’s attorney three decades ago.


Trump attorney Alina Habba changed course Tuesday two hours after Carroll’s lawyer Roberta Kaplan blasted her in a court filing for raising “utterly baseless” questions about her past ties to US District Judge Lewis Kaplan, with whom she worked at Paul, Weiss, Rifkind, Wharton & Garrison for less than two years in the 1990s. Kaplan — who isn’t related to the judge — raised the prospect of seeking sanctions against Habba over her “false allegations.”




“Since Ms. Kaplan has now denied that there was ever a mentor-mentee relationship between herself and Your Honor, this issue has seemingly been resolved,” Habba said in her letter to the judge."

Trump's defense grills E. Jean Carroll about old social media posts in rape allegation trial

In Carroll's last day of scheduled testimony, Trump lawyer Joe Tacopina asked her about old Facebook posts in which she praised Donald Trump's reality show "The Apprentice."

Carroll, whose lawsuit alleges Trump raped her in a New York City department store in the mid-1990s and defamed her by calling her claims a "hoax," acknowledged praising the show on Facebook in 2012, when it was still on the air.


"I was a big fan of the show. Very impressed by it," Carroll said on the witness stand Monday.

"I had never seen such a witty competition on TV, and it was about something worthwhile, competing," she said, adding that while she enjoyed the contestants and the competition, she didn't like the parts with Trump firing people. "I didn’t watch that part," she said.

Carroll, 79, said she posted positively about the show because "two of my friends appeared on it and I wanted to boost it."

She was also asked about a 2012 post in which she asked people whether they would have sex with Trump for $17,000 and could keep their eyes closed during it.

"Yes," she said when she was asked whether she'd written the post. "I made several jokes about Donald Trump."

She later testified under questioning from her lawyer that she wrote the post because "it's much better to laugh than cry," adding, "Laughter picks up my spirits."

Carroll also acknowledged to Trump lawyer Joe Tacopina that in the decades after the alleged attack at the Bergdorf Goodman department store in Manhattan, she kept shopping at the store.

"It is not a place I am afraid to enter," she said.

In a testy exchange, Tacopina asked Carroll why she had sued Trump but not former CBS CEO Les Moonves, who also denied her claim that he once sexually assaulted her.

"He just denied it," Carroll said of Moonves. "He didn't call me names and grind my face through the mud like Donald Trump did."

I think the important questions out of this whole ordeal are (1) why is Trump unable to control his emotions which has resulted in the huge defamation judgement against him which was completely self inflicted and (2) why is Trump unable to surround himself with appropriate professionals who can mount the best possible defense? The answers to (1) is of course that Trump unable to control his emotions even when intellectually he knows it is to his detriment. The answer to (2) is that he is either not paying his attorneys again or is unwilling to take their advice and hires a yes man (or woman in this case) who follows his orders instead of mounting the best defense.

I don't know when public perception of what makes a good leader changed from a cool and collected man to one who cannot control his emotions.

There is a reason Dollar General Melania is back peddling. Even though she is a shit lawyer, she seems smart enough to know she does not want to go down that road and pay a fine or be like countless other Trump lawyers and lose her license.
It was known prior to the trial the judge and E Jean Carroll's lawyer worked in the same firm for a couple years. It is not unusual for a judge to preside a case with a lawyer they worked at the same firm. He would have to recuse himself if they worked on a case together which they did not. So someone from the Trump camp got the New York Post to post an anonymous source which then Dum Dum Habba quoted hoping that would buy her cover, but unfortunately because she is dumb, the time line does not support that argument. Carroll's lawyer basically told Habba keep fucking around and you will find out. Which now leads us to watching Habba tuck her tail and drop it.
The bigger picture does this count as another L for Habba. She is 0-3 so far and I really want her to catch Drunk Rudy's 65 L's record. I doubt she will be around that long.
