Trump's DOJ is losing about 90% so far. The DOJ, historically, have a success rate well about 90%. This is clown shit. It's incompetence, and even conservative judges are getting pissed. A Trump-appointed judge just wrote a scathing judgement. I guess I should be thankful that these people are incompetent, but the judicial system is slow, and people are being wronged as these cases work through the courts.

As for not prosecuting him before, they could have looked into his individual case, but why bother when you could just deport him to El Salvador for way cheaper.

Now, in reality, you and I might say "Well he was going to CECOT, so he obviously wasn't going to reoffend", but I don't think the Trump admin can make that argument, legally, because then they are admitting to deporting folks to be incarcerated without conviction.

Fair enough. I just don’t think the Trump admin even knew he was a human trafficker, just an identified gang member.

When he was stopped in the process of trafficking people, for some reason the FBI let him go and the police department tried to hide it for some reason. It was leaked and then went viral, at least from an outside perspective. Who knows what happened behind the scenes.

Prior, all that was known was that two different judges were presented confidential information and they both determined he was a gang member based on what and should be deported.

It's true that deporting people into brutal prison systems without due process is dictatorial and behaviour.

What someone above quoted Pelosi as saying, that M-13 gang members are still human beings who (depending on your belief system) still have a spark of the divine in them is even true.

But it's also true that Dems are just brutal at winning these sorts of issues, despite being clearly correct in principal and in their vision of any sort of legal structure under which any sane person might want to live, because rather than make their sound points in a measured tone, they without exception jump to lionize just some of the worst people on the planet and make them a cause célèbre.

And by doing so, they successfully shift the debate to the character of the person involved, rather than the legality and principal of what it all means for everyone, and when that backfires, they're left holding the bag and hoping to shift the conversation back... but good luck because they were the ones who shifted it in the first place.

2 judges found the information credible that he was a gang member and gave him the deportation order. What legal aspect was not followed?
