Active doesn't equal being a top fighter. He just beats really low tier fighters and loses to anything above that.

No one can legitimately say he deserves a spot on the UFC roster. Looking through his record, his biggest wins are over Brad Kohler, Wes Sims, Joe Riggs (HW), Cabbage, Heath Herring. The great majority of wins over guys with losing records. His 49 losses are against the likes of Arlovski, Monson, Ricco, Wiuff, Rothwell, Forrest Griffin, Jeremy Horn, Evan Tanner, Dan Severn, and many more. The guy is a solid test for up and comers, but thats it. He also has a 18-31 boxing record.
