Emergency Powers of the POTUS were created for a very specific reason and that reason is for when an Emergency happens that the POTUS does not have time to wait for the Congress to go through the normal processes of debating and acquiring funds to address.

So think of a serious natural disaster or a military invasion of the US. the POTUS needs to be able to act immediately (its an emergency) and not wait until Congress has time to table it and debate it and pass it.

In ALL instances where there is no urgency and Congress HAS THE TIME to table it and debate it, that is NOT an emergency (as per the emergency act) and the POTUS has to let it pass through that normal course as Congress is responsible for allocating money to spending priorities. It is a clear 'Separation of Powers'.

In THIS instance POTUS clearly had the time (no emergency) to table and have them debate it, and he got turned down. the Congress did not agree this was a spending priority. THAT IS THEIR RIGHT. POTUS does not get to say 'they are wrong this is a priority, and I will spend the money' as that is exactly why Congress exists. They determine if its a spending priority and they allocate money. A POTUS disagreeing, does not give him the ability to go around and spend anyway (Separation of Powers) and if it did then there is no need for a Congress, the POTUS will simply rule by decree and tell Congress, you will either agree with my priorities or I will shove you aside and do it anyway (thus NO separation of powers).

No court will allow the destruction of the Constitution and the Congress being made impudent like that as this precedent would then be used by future POTUS in all sorts of situations.

Trumptards who pretend they support the Constitution once again show there is nothing (deficits, debt, constitution, etc) that they won't abandon for Trump.

President Trump declares border emergency in bid to divert billions for wall, predicts court fight

President Trump said Friday he is declaring a national emergency on the southern border, tapping into executive powers in a bid to divert billions toward construction of a wall even as he plans to sign a funding package that includes just $1.4 billion for border security.

“We’re going to confront the national security crisis on our southern border … one way or the other, we have to do it,” Trump said in the Rose Garden.

The move is expected to face a swift and forceful legal challenge that could stall the attempt in the courts for the near future. But the declaration and other money-moving plans allow Trump to continue to fight for border wall construction while also averting another partial government shutdown -- which would have been triggered at midnight absent the new funding package.

Trump, in the Rose Garden, declared once again that "walls work" as he confirmed he'll sign the emergency declaration.

"We’re talking about an invasion of our country," Trump said.

And in an almost-casual tone, the president predicted a legal fight that will wind up before the Supreme Court.

"We will have a national emergency, and we will then be sued," Trump said, adding that the federal appeals courts could well rule against his administration. "Then we’ll end up in the Supreme Court, and hopefully we’ll get a fair shake, and we’ll win at the Supreme Court -- just like the [travel] ban.”

He knows the legal challenges are coming and that he is not so confident in the Supreme Court considering Chief Justice Roberts being the swing vote(who almost always voted against him).


Also he's going to have to explain this statement to the Justices as well:

"I didn't need to do this, I just want to get it done faster."


Pretty much damages his case from the get-go.

His lawyers / attorneys / representatives better come up with something to explain away this statement.

he knows he will lose. But he also knows this could drag thru the courts for years so it will be his big election issue going into the next election.


Trump wants border security and the idea he is the only one fighting for it front and centre. He could care less if he wins or actually gets his wall as he knows he will lose. Its the rhetoric and talking point he wants.
