Seems like the longer they can litigate on every single issue, the better, as the pressure to nix the investigation will only increase the longer it goes on. And it's not like Trump is lacking funds and needing to be strategic in his legal fee expenditures. Just seems like a real boner move to me.

Somewhat. Imo the key is that this is parallel to the Mueller investigation - the docs technically came out as an investigation v Cohen. So throwing up barriers here doesn't accomplish much vis a vis the main threat. And there's other issues - it might be redundant with already-existing information, etc.

I'm also open to the idea that they just blatantly fucked up somehow. I think thats less likely than a tactical decision that didn't work out as planned, though. Trump's new attorneys aren't as incompetent as his first set. If we don't count Giuliani as one.

What is probably most humorous to me about Trump's legal defense is how just about every major firm and notable partnership took one look at the prospective client and was like:

Trump is the holder of the privilege, and his current attorneys are acting as his representatives in this matter. They may waive privilege on his behalf. When people say "the attorney cannot waive attorney client privilege" they refer to the attorney to whom the privileged communication was made, and the fact that he may not do so unilaterally. If an attorney - especially a different attorney- is acting as the representative of the client, he is not acting unilaterally and may waive on behalf of his client.


The attorney who cannot waive attorney-client privilege is Cohen.

Okay. So a more accurate statement is Trump waived the privilege. Trump holds the privilege. His attorneys who are representing him now can’t assert that privilege unless Trump consents. So Trump waived the privilege.

Unless you can quote me the rule from the ABA’s Model Rules for Professional Conduct that says that an attorney can unilaterally waive a client’s attorney client privilege, Trump would have to sign off on this.

It's incredible. I had trouble imagining a client so notoriously difficult that biglaw universally had scruples about representation.
