@Scheme, this is pathetic. The tense of my sentence is the subjunctive. So, no, it's untenable to claim any burden of proof lies with me because it's conditional.This is your post. See the line:

You don't know this person at all. You don't know if they are desperate people, or people who simply entered the US to commit crime, smuggle drugs, etc. The burden of proof to say that this person in the OP was a "desperate person" is on you because you made the claim.
