it's only considered ABH down under? Strange, in the UK a broken jaw would be deemed GBH in most cases and I couldn't see anything but a custodial sentence, but yes each case to it's own.

It varies from state to state. In Queensland a broken jaw pretty much guarantees GBH and jail time. In NSW I don' t think so.

If he really wanted to get one back he should have just beat the shit out of the guy. He's still be in trouble but given that the group was following them it wouldn't be half as worse as bad as breaking a girl's haw.
 
Well, if you were in the US, jail time for sure. Especially since it was a women. Leniency would be thrown out the window.

Only thing that could potentially save you is that you felt threatened, but why would you punch the chick? Lawyer is your only hope.

It sucks that a bunch of complete assholes fucked with you and you are going to pay for it in the end, but you gotta be smarter then that. I mean hitting a women? Sorry, but that's just fucking stupid.
 
If you are not enough of a man that you are actually scared you're gona get hurt by a woman swinging on you or you cant take an insult from someone weaker than you without lashing out and breaking their jaw then i understand. Its a cliche term but sometimes the best defense is a good offense. Are you supposed to let 4 people start beating the shit out of you before you hit back?

I lived in Australia for a year. Ive seen 4 sets of people fucking in the bathroom. Although in the toilet. Not on the sink. I also saw it in Laos. With two australians. Ive never seen it anywhere else in the world. I think its pretty disgusting too.

I have lots of aussie friends. They are great people. But I noticed they were rough in ways I hadnt seen before. For instance...

One night I was at the Grand in Adelaide (shout out to anyone who is from Adelaide. The Jetty Road is awesome). I saw a guy get thrown out of the club and get beat on by bouncers. Turns out it was thats guys birthday apparently. That didnt go over well with his friends in the club. They came out and started shit with the bouncers. Then I think a bunch of others showed up for the birthday party. They found out what happened and went nuts. I wound up watching around 30 guys fighting with the riot squad. With riot shields.

I also saw a 15 vs 10 fight amongst big lebanese guys outside of Star Bar in Sydney right before New Years eve. I figured it had to be gang related. I was actually 18 at the time and I was so drunk. I was playing with this 28 year old germans girls boobs :)! Literally all but 3 guys on one side KOd. Then there was 1 guy left on the other side. He sprinted and the bouncers let him dive back into the club. They protected him. He dove head first into the door. To escape those 3 guys. They were close too.

Ive never seen anything like that in Canada. I knocked a guy out in a public place when I was 17. The cops came and they didnt even talk to me. They just talked with him. He was way bigger then I was and 23 years old. I dont think he went to jail. He threw the first punch though. Witnesses backed that up apparently.

I was at a nightclub and Casino in Canada a few months back and a ridiculously drunk guy kept bugging the girls and then my friends. So we told him to piss off. He shoved a friend of mine and he got one punched KOd into a slot machine. They had to streture him out. It was an akward situation because he was too drunk and I dont think a punch was warranted. The cops didnt do anything to him for that though. I wonder what the rule is on a shove? Does that warrant self defence? Well my friend didnt get in trouble so I guess so.

I would say they shoved you in the urinal and threatened to stab you. You told your brother and he wanted to avoid confrontation. So you immediately left. They chased you down and your brother was nervous they were going to attack. So he tried to be a heroic big brother and told you to run while he kept them at bay. The girls jaw was broken on account of a missed punch while fighting off 3 of them.

Thats what could be said. Unfortunately your brother probably said alot to the cops that could negate that story. He probably told them he lost his temper. Thats why its best to say nothing if you know its serious and wait for a lawyer or to talk it over with you.

That story would be fine as long as there was no confession, no witnesses and no cameras. But if you wait and have a lawyer I believe that information has to be presented to you. Then you can build your story.
 
I think since it's Australia, the courts have to be considerably more lenient with sentencing in cases of violence, because they can't just throw 89% of the population into prison, can they?

bahaha! Ya I feel they are pretty violent. Canada is too though. When I was a bit younger I would see a fist fight or two every night I went out. I think it has something to do with hockey. I dont like hockey but its Canadas sport and you can drop gloves and fight and get a 5 minute penalty. We all grew up watching that. Its reflected in the clubs.
 
Your brother needs to learn to control himself, and there's a chance that he's being "offered" a place for that.
 
Most likely your brother is going to get assault charges. He really shouldn't have hit the girl to start it. I personally don't think it should matter, but to most people it will. Now, the 2 guys against him I don't think it matters that he hurt them more if they were fighting too. That would be mutual.

If I was you, I'd make sure that your brother prepares is story very well to show that he was scared this group was going to follow you two and possibly attack you. That is your only chance of not getting charged. Technically, you don't have to actually be physically attacked to be in the right for self defense. You just have to fear for you well being. If you feel they were going to follow you and attack you, you may be able get away with this.

Yeah, I believe there's a high frequency in other places like Canada (or many parts of).

What sets Australia apart is not the mere frequency of altercations but the sheer horrific level of unrestrained gore and maiming in everyday confrontations. I won't even say they "escalate to" the high level, as it seems they are immediately already there upon initial contact, as it is hardwired in the Australian (cultural?) mindset. The way you know it didn't "escalate/build" to redline is by the fact that no bystander/participant (in Aus) is outraged or appalled afterward. Seems as they express regret occasionally, if that, in rare circumstances after being goaded to do so. It must be instinctive to the point of passe to them, that's the only answer I can think of

These are just my observations. No hate or downtalk here. I cherish Aussies. To me (and some assumed others), their wolverine rage is simultaneously mind-shatteringly impressive and challenging to fathom

Strangely enough he didnt feel threatened in the bathroom when some guy was in his face while ur brother had his lil dong out at the urinal. And from how u tell the story it sounds like the guy in the bathroom had a boner too since he was just having sex. So a guy w a boner and pants half on in ur brothers face at the urinal didnt threaten ur brother enough to do anything at all. But when its a girl, then your brother is a big man. I hope he enjoys prison. There wont be any girls for him to beat up there. And they dont like woman beaters in prison. He'll have a real good time
