I have quite a bit of quasi legal experience in Aus from various jobs that I have had, so I will offer some advice and commentary.
First off, your brother is a dickhead for hitting anyone based on a verbal confrontation. The fact that he is a trained boxer and it is a girl, well, colour me stupid. He is going to have to take his lumps.
1. Right now, today, this fucking minute get him in an Anger Management or other suitable rehab program you can find. Voluntary steps toward rehabilitation are looked at very favourably by the court, even more so if they are voluntary and not organised by a solicitor.
2. Fuck legal aid. They are so overwhelmed they are really just there on the day to help with procedural matters in front of a magistrate and make sure the paperwork is ok. They are not going to be doing much behind the scenes to assist you as you will be one of 250 assault cases the Legal Aid Lawyer will have currently on the books. Along with 500 drug possession charges, 250 Break and enters, and 300 Violence Restraining Orders.
Beg, borrow, scrimp save, or get a loan. Get a lawyer who specialises in assault or GBH who can help you plead down the charges.
3. If you have not already you need to create a detailed written contemparaneous record of exactly what happened. This should detail the nights events in as much relevant detail as possible. Do not colour it to try to make your position look better, it should be an accurate record. This will assist both of you in recall and help make your recall stronger. Helps to have this well documented as you will be asked via cross examination to review the nights events.
It is your lawyers job to use the events and give mitigating circumstances that the magistrate may use in your favour in sentencing.
4. Plead guilty to whatever you can get the charges knocked down to. Prepare, write down and practice an apology to the girl/other parties. You are not going to win this case with a John Grisham twist.
5. Raid an op shop or whatever you have to do to appear in a suit, tie and decent shoes. Be respectful in court. You'd be suprised what a difference the right attitude and a neat and contrite demeanour can make.
6. Tell your brother to grow the fuck up. And don't listen to the misoginistic mongoloids on this site. Belting girls is not on. Be the bigger person.
