Guy could possibly make a civil case out of it but based on that angle alone it would not make for a good criminal case. Cant prove beyond a reasonable doubt Schilling did not fear incoming bodily harm and his response was not overly disproportionate. Many people feel that way because he's a professional fighter but Its just a a guy one shot ko'ing another. It happens even in civilian v. Civilian conflicts. Schilling should have acted differently but what he did does not rise to the criminal level given the circumstances.

with the lower civil standard assuming Schilling had money that little incident could cost him as the surrounding facts and other stuff Schilling has posted could negate a possible affirmative defense.
