You're proving my point. What you are citing is an exception to providing a service through membership. This does not fall under the Fair Housing Act. But that is not the case with RTTL

You are in very rare cases able to deny membership SERVICES based on race/religion/etc but it is illegal to deny housing by using membership as a barrier. When part of your business includes property management of some form, you cannot use race as a criteria to deny someone.

This settlement is not a private club because enrollment is open to public but under a discrimination parameter.

It very well could not meet the requirements of a legal private club. It's very strict criteria to meet that.

whilst we are on the subject of how the suburbs excluded black people as a matter of policy back in the 50s, the access to Home Loan Guarantees (or lack thereof) for black veterans under the GI Bill was similarly, and systematically discriminatory.
